EXHIBIT "C" <br />Revised Conditions of Approval <br />Case UP -94 -10 <br />(September 29, 1994) <br />1. Development shall be substantially as shown on the site plan <br />and building floor plan and elevations, Exhibit "A ", dated <br />"Received August 30, 1994" on file with the Planning Depart- <br />ment, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval <br />of the Planning Director if found to be in substantial <br />conformance to the approved exhibits. <br />2. The effective date of this conditional use permit shall <br />coincide with the effective date of the major modification <br />Case PUD- 80- 15- 5D -4M. If the modification is denied by the <br />City, this conditional use permit shall become void having no <br />further legal force and effect. <br />3. All building plans must comply with all codes and ordinances, <br />including the Pleasanton Fire Code (Chapter 20.24 of the <br />Pleasanton Municipal Code), in effect before the Building <br />Department will issue permits. <br />4. In the event complaints are received by the Planning Director <br />regarding: a) level -of- service and traffic flow at the Santa <br />Rita Road /Pimlico Drive /I -580 off -ramp intersection, b) in- <br />gress /egress at the Santa Rita Road and Pimlico Drive en- <br />trances to the Pleasant Village shopping center, c) blocked <br />parking spaces or driveway aisles, d) noise, e) litter, f) <br />rowdy behavior, or g) other problems occurring as a result of <br />the operation of the espresso stand at this location, the <br />Director of Planning may refer the subject project back to <br />the Planning Commission for review; the Planning Commission <br />may at that time attach new conditions as necessary to elimi- <br />nate /minimize the problem or may revoke the conditional use <br />permit. <br />5. The proposed signage is not approved. Signage shall be <br />limited to the building signs. No freestanding signs are <br />allowed. A revised sign plan for the proposed use shall be <br />submitted to the Planning Director for review and approval. <br />6. The applicant shall obtain all building and other applicable <br />City permits for the project prior to the commencement of <br />construction. <br />Page 1 <br />
