BAAQMD Regulation 13, Rule 1 Requirement <br /> <br />Appeal Plan Disapproval: Section 13-1-409 provides a proces~ for employers m appeal a <br />plan disapproval to the Employer Trip Reduction Appeals Commiltee. <br /> <br />Local Jurisdiction TRO Requirement <br /> <br />SectionNumber(s): 17.24.090 Review & ApprovaFRevision of TDM Program <br /> <br />Explanation (if necessary): If the Pleasanton Coordinator rejects an employer's plan. the <br />employer can appeal to the TDM Task Force. If the TDM Task Force rejects the plan the <br />employer can appeal to the City Connell. The City Council may approve, modify, or <br />overrule the action of the TDM Task Force. <br /> <br />BAAQMD Regulation 13, Rule 1 Requirement <br /> <br />Define Violations: A violation of the BAAQMD rule occurs whenever an employer fails to <br />meet the requirements specified within the role. Failure to achieve the AFR or FER <br />performance objectives at an affected work site is not a violation of the rule. Failure to do <br />any of the following would be violation(s): noti)52 employees, conduct employee surveys, <br />appoint an Employee Transportation Coordinator and Program Manager, register, develop <br />and implement an Employer Trip Reduction Program, submit an Employer Trip Reduction <br />Plan or update as applicable, revise and resubmit any disapproved plan, have an appmved <br />Employer Trip Reduction Plan, or implement an approved Employer Trip Reduction Plan. <br /> <br />Local Jurisdiction TRO Requirement <br /> <br />Section Number(s): 17.24.100 Enforcement <br /> <br />List violations: Failure to provide: survey data; annual reports, and/or provide and <br />implement a TDM Information Programs and TDM Programs. <br /> <br />Describe the process the local jurisdiction will use to identify and notify employers of <br />violations: <br /> <br />Every employer and/or complex who falls to comply with any provisions of this ordinance <br />shall have thirty (30) days after notice of such failure, to correct the failure or be guilty of <br />an infraction punishable as in Section 17.24.100A. <br /> <br />Additional Explanation (if necessary): <br /> <br />Page 11 <br /> <br /> <br />
