Resolution No. 00-034 <br />Page Three <br /> <br />Development impact fees are due at the time a building permit is issued; the <br />initial plans for the second floor commercial uses were not submitted to the <br />City until after new development impact fees were in effect; therefore the <br />proposed conversion of 3271 square feet from attic area to second floor <br />commercial uses is subject to the development impact fees. <br /> <br />The freight elevator installed at the property does not meet the minimum <br />size required for accessible passenger elevators, given the type of <br />occupancies proposed for the second floor, and the City's Director of <br />Building Inspection Services has denied a request for a hardship, which <br />determination is not subject to appeal to the City Council. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The appeal of Ed Churka is denied in all requests. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br />Section 3: <br /> <br />The City Clerk shall send a copy of this resolution to the appellant informing him <br />that he has ninety (90) days from the adoption of this resolution in which to seek <br />judicial review of this decision. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETiNG HELD ON APRIL 4, 2000 BY THE FOLLOWiNG VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarver <br />None <br /> <br />A~TO;~,ZZRMd,,_ <br /> <br />Michael H.
