CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-034 <br /> <br />RESOLUTION DENYING THE APPEAL OF ED CHURKA <br /> <br />WHEREAS, <br /> <br />at its meeting of April 4, 2000, the City Council considered the appeal of Ed <br />Churka concerning the application of certain Building Code requirements and <br />development fees to the proposed second floor commercial uses at the property <br />located at 780 Main Street (Coffee Roast Express); and <br /> <br />WHEREAS, Council received the staff report from the Director of Building Inspection <br /> (SR 00:081) regarding this matter; and <br /> <br />WHEREAS, a duly noticed public hearing was held at which time all pertinent testimony and <br /> documents were reviewed; and <br /> <br />WHEREAS, the Council finds as follows: <br /> <br />The building at 780 Main Street, including the basement, exceeds 8,000 <br />square feet if the second floor is converted to (or allowed to be used for) <br />commercial purposes an the Uniform Building Code, as adopted by the City <br />of Pleasanton, requires that all buildings exceeding 8,000 square feet be <br />equipped with fire sprinklers; therefore, the building at 780 Main Street is <br />required to have a fire sprinkler system if the second floor is converted to <br />(or allowed to be used for) commercial purposes. <br /> <br />Certain legally required life/safety features for the building at 780 Main <br />Street have not been designed or submitted with building plans. These <br />include exit stairs from the second floor, an elevator to the second floor <br />accessible to persons who are disabled, and access to an electrical <br />disconnect for each prospective tenant. Because it is imperative that all <br />life/safety issues be in place prior to the City's issuing building permits for <br />tenant improvements on the second floor, the Building Department has not <br />placed an unfair or reasonable hold on the second story improvements. <br /> <br /> <br />
