However, the <br />Lead Agency may require the person to supply data <br />'and information, both to determine whether the pro- <br /> ject may have a significant effect on the environment, <br /> and to assist in the preparation of an EIR by the <br /> agency. This info~nnation may be submitted in the <br /> form of a draft EIR, if the agency desires. If in- <br /> formation is provided in the form of a draft EIR, <br /> the Lead Agency may not use the draft EIR as its own <br /> without independent evaluation and analysis. The <br /> draft EIR which is sent out for public review must <br /> reflect the independent judgment of the Lead Agency. <br /> The Lead Agency should require an applicant to specify <br /> to the best of his knowledge which other public <br /> agencies will have jurisdiction by law over the <br /> project. <br /> <br />Obligations of a Lead Agency. <br /> <br />(d) <br /> <br />Where the provisions of subsections (a), (b), and <br />(c) leave two or more public agencies with an equal <br />claim to be the Lead Agency, the public agencies <br />may by agreement designate which agency will be the <br />Lead Agency. <br /> <br />Use of Single EIR. The City may employ a single EIR to <br />describe more than one project, if such projects are essen- <br />tially the same in terms of environmental impact. Further, <br />it may use an earlier EIR prepared in connection with an <br />earlier project to apply to a later project, if the circum- <br />stances of the projects are essentially the same. It may <br />elect to write EIR'S in advance for entire programs or <br />regulations, in order to be prepared for project applications <br />to come. Whenever it chooses to utilize any of these alter- <br />natives, however, it must find that the environmental effects <br />of the projects are similar enough to warrant the same <br />treatment in an EIR and that the EIR will adequately cover <br />the impacts of any single project. If these tests are not <br />met, it should supplement the EIR it prepares to a program <br />to apply to to an individual project. <br /> <br />Processing Negative Declaration and Environmental Impact <br />Report After Appeal Period Lapses. <br /> <br />(a) Negative Declaration. <br /> <br />(3) <br /> <br />If the project requires discretionary approvals <br />from a state agency, the Notice of Determination <br />also shall be filed with the Secretary for <br />Resources. <br /> <br />-4- <br /> <br /> <br />
