City, pursuant to the funicipal Improvement Act of 1913, <br />adopted its Resolution of Intention No. 74-194 on October 14, 1974, for the <br />formation of a special assessment district designated ASSESSMENT DISTRICT N0. <br />1974-10, PELERS P,VENUE PARKING L.I.D., (District), to accon;plish, among other <br />thinns, the installation of a new underground electric street lighting system <br />(Street Lighting Facilities). These facilities, consisting of four (4) 175 <br />r•:att and tr;~o (2) 250 watt mercury vapor luminaires r-rill be installed on ne~~r <br />steel poles, as shown on the attached sketch marked Exhibit "A" and made a <br />part hereof. <br />2. Under the special assessment district proceedings referred to <br />above, the Street Lighting Facilities are to be constructed by PGandE with the <br />exception of those facilities to be installed or caused to be installed by <br />City as shown on Exhibit "A" <br />3. The ownership of the Street Lighting Facilities shall vest in <br />PGandE, pursuant to the provisions of Sections 10109, 10110 and 10111 of the <br />California Streets and High rays Code. <br />NOIJ, THEREFORE, IT IS ^1UTUALLY AGREED AS FOLL061S: <br />1. City shall install or caused to have installed, in accordance <br />with PGandE's specifications, the pole bases, splice boxes, conduit and riser <br />bend ar~d perform the necessary trenching, backfilling and excavation in connection <br />r <br />, P: <br />1: s., <br />
