CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 75-155 <br /> <br /> A RESOLUTION DENYING THE APPEAL OF PLEASANTON <br /> BODY SHOP FROM A DECISION OF THE PLANNING <br /> COMMISSION AND DESIGN REVIEW BOARD IN REGARD <br /> TO ACCESS TO VERVAIS AVENUE. <br /> <br />WHEREAS, on JUne 11, 1975, the Planning Commission approved <br /> cases Z-75-83 and UP-75-13 for the construction of <br /> a commercial service building at 4262 Stanley Boulevard, <br /> subject to conditions set forth in Planning Commission <br /> Resolutions No. 1350 and No. 1351; and <br /> <br />WHEREAS, Condition No. 3 of said resolutions prohibits vehicular <br /> access from the property in question to Vervais Avenue; <br /> and <br />WHEREAS, the owner of said property, Mr. Alvin Bernard, within <br /> <br /> the time limit specified in the mUnicipal code, appealed <br /> the decision of the Planning Commission and Design <br /> Review Board with respect to said vehicular access to <br /> Vervais ;Avenue; and <br /> <br />WHEREAS, the City Council, at its meeting of July 14, 1975, <br /> <br /> held a public hearing to consider Mr. Bernard's appeal; <br /> and <br /> <br />WHEREAS, during the course of this hearing, any and all persons <br /> <br /> were offered the opportunity to present evidence and <br /> information to the City Council with respect to this <br /> particular question. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. There is substantial evidence to support the finding <br /> of the Planning Commission that the applicant has <br /> access to Stanley Boulevard and that the use on the <br /> property will not create a burden within the property <br /> such as to necessitate access to Vervais Avenue. <br /> <br /> <br />
