CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 76-65 <br />AUTHORI7_ING THE ESTABLISHT'fENT OF A SEPTIC TANK ON FOOTHILL <br />ROAD FOR PROPERTY BELONGING TO MR. AND MRS. ROBERT W. BYRD <br />WHEREAS, the City Council, at its meeting of August 26, 1976, con- <br />sidered a request from Dr. and rYrs. B. L. E11is, of <br />Livermore, for the establishment of a septic tank on a <br />piece of property near Foothill Road in the City of <br />Pleasanton which Dr. and Mrs. Ellis were in the process <br />of acquiring; and <br />WHEREAS, the City Council authorized the construction of a septic <br />tank on said property (which is more particularly describe ~ <br />in Exhibit A attached hereto and incorporated herein by <br />reference), subject to compliance with the provisions of <br />I <br />Resolution No. 73-139 (Establishing a Policy Regarding <br />~ the Use of Septic Tanks in the City of Pleasanton) and <br />the execution of a septic tank agreement with the City <br />of Pleasanton; and <br />WHEREAS, Dr. and Mrs. Ellis did not execute an agreement with the <br />City of Pleasanton; and <br />WHEREAS, the City has been advised that Dr. and Mrs. Ellis dropped <br />their negotiations to acquire said property for which a <br />septic tank had been approved; and <br />I~7HEREAS, the property in question has been acquired by Mr. and <br />Mrs. Robert Byrd; and <br />WHEREAS, Mr. and Mrs. Byrd have requested that the City Council <br />grant to them the right to construct a septic tank on the <br />property upon which a previous request for a septic tank <br />had been approved; and <br />WHEREAS, at their meeting of February 9, 1976, the City Council <br />considered said request, together with report of the <br />Health Department made at the time of Dr. and Mrs. Ellis' <br />request for approval, as well as staff report regarding <br />
