WHEREAS, subsequent to the holding of the public hearing the <br />City Council considered this application together with <br />Resolution No. 14-19 of the Planning Commission, the <br />Minutes of the June 9, 1976 Planning Commission meet- <br />ing, the Staff Reports of July 7, 1976 and June 9, 1976, <br />and the arguments presented at the City Council's <br />public hearing. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br />Section 1. Upholds the appeal of Joseph Schwab to a decision <br />of the Planning Commission approving case UP-76-11 to <br />allow the construction and operation of a self-service <br />gasoline station on property located at the north-west <br />corner of Hopyard Road and Johnson Industrial Drive <br />for the following reasons: <br />1. A self-service gasoline station will generate ad- <br />ditional traffic at the corner of Hopyard Road and <br />Johnson Industrial Drive. Said intersection has <br />been a continual traffic problem since 1969 and a <br />street light has only recently been installed at <br />said corner for purposes of traffic control. The <br />approval of an application for a self-service gaso- <br />line station at this corner at this time without <br />further evidence of the affect of traffic upon the <br />signal light at the corner of Hopyard Road and <br />Johnson Industrial Drive, would be detrimental to <br />the public health, safety, or general welfare. <br />2. Concerned about the economic impact of proposed self <br />service station upon adjacent service stations. <br />3. Unable to make the necessary findings required by <br />~2-11.08, Article 25 (Conditional Uses), Chapter 2 <br />(Zoning) of Title II (Zoning and Planning) of the <br />Ordinance Code of the City of Pleasanton. <br />-2- <br />
