CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 76-168 <br />A RESOLUTION SUSTAINING THE APPEAL OF JOSEPH <br />SCHWAB TO A DECISION OF THE PLANNING COMMISSION <br />APPROVING CASE N0. UP-76-11 TO ALLOW THE CON- <br />STRUCTION AND OPERATION OF A SELF-SERVICE GASO- <br />LINE STATION ON PROPERTY LOCATED AT THE NORTH- <br />WEST CORNER OF HOPYARD ROAD AND JOHNSON INDUS- <br />TRIAL DRIVE <br />WHEREAS, Vernon Dickman applied for a conditional use permit <br />to allow the construction and operation of a self- <br />service gasoline station at the north-west corner <br />of Hopyard Road and Johnson Industrial Drive; and <br />WHEREAS, on June 9, 1976 the Planning Commission of the City <br />of Pleasanton considered case UP-76-11; and <br />WHEREAS, at said meeting the City Planning Commission held a <br />public hearing at which the applicant and any member <br />of the public was allowed to speak in favor or in oppo- <br />sition to this particular conditional use permit; and <br />WHEREAS, subsequent to the close of the public hearing the <br />Planning Commission approved UP-76-11, adopting Reso- <br />lution No. 14-19; and <br />WHEREAS, subsequent to the entering of Resolution No. 14-19, <br />Mr. Joseph Schwab,on behalf of six (6) service station <br />owners, filed an appeal with the City Clerk of the <br />City of Pleasanton in order to have the action of the <br />Planning Commission with respect to UP-76-11 reviewed <br />by the City Council; and <br />WHEREAS, the City Council at its meeting of July 12, 1976, con- <br />sidered said appeal by holding a public hearing at <br />which time the appellants and the applicant were af- <br />forded the opportunity to speak, present evidence and <br />witnesses as well as allowing any other member of the <br />general public to speak on this particular matter; and <br />-1- <br />
