WHEREAS, at this meeting of July 12, 1976 the City Council <br />considered Mr. Safreno's appeal from an adverse de- <br />cision of the Planning Commission and allowed Mr. <br />Safreno, his representatives and other members of <br />the public to speak on this matter; and <br />WHEREAS, subsequent to receipt of testimony the public hearing <br />was closed and the City Council deliberated. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br />Section 1. Denies the appeal of Douglas Safreno from an ad- <br />verse decision of the Planning Commission in regard <br />to case RZ-75-12 for the same reasons as indicated by <br />the City Planning Commission in its decision on <br />October 8, 1975, to wit: <br />1. A rezoning of the property would constitute an <br />extension of commercial development along First <br />Street which is not in the best interest of the <br />public health, safety and welfare. <br />2. Approval of the application would be a continuance <br />of spot-zoning which also would not be in further- <br />ance of the public health, safety and welfare. <br />3. The approval of the use would increase traffic and <br />parking problems in the general vicinity which would <br />be inamicable to the public health, safety and <br />general welfare. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />THIS RESOLUTION WAS ADOPTED ON JULY 12, 1976 BY THE FOLLOWING VOT <br />AYES: Councilmembers - Brandes, Herlihy, LeClaire, Mercer and <br />Mayor Philcox <br />
