NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. Denies the appeal of Mr. Eddie Sanders from an <br /> adverse decision of the Board of Adjustment in case <br /> V-76-12, denying a request for a free standing sign to <br /> be located in front of the 7-11 store at 3760 Hopyard <br /> Road. The basis for this denial are the following: <br /> <br /> 1. No evidence has been presented to indicate that <br /> there are exceptional or extraordinary circumstances <br /> or conditions applicable to the property involved <br /> <br />that do not apply, <br />classified in the <br />subject property. <br /> <br />generally, to other properties <br />same zoning district as the <br /> <br />2. There has been no evidence presented which indicates <br /> that the interpretation and enforcement of the <br /> regulations of the ordinance code, with respect to <br /> location of signs, denies the applicant of any <br /> privileges enjoyed by owners of other properties <br /> classified in the same zoning district as his <br /> property. <br /> <br />3. The granting of a variance to Mr. Sanders in this <br /> case would constitute a grant of special privilege <br /> inconsistent with limitation on other properties <br /> classified in the zoning district as Mr. Sanders. <br /> <br />4. The granting of the variance would be detrimental <br /> to the public health, safety and general welfare <br /> since it would cause a proliferation of signs in <br /> an already congested area along Valley Avenue. <br /> <br />5. Mr. Sanders is located in a CN (neighborhood com- <br /> mercial) district and a free standing sign is <br /> not necessary for businesses located in such dis- <br /> tricts since it is intended to attract people from <br /> <br />-2- <br /> <br /> <br />
