subject to the following conditions: (a) A four-year time limit be attached to the Condi- tional Use Permit, UP-76-17. (b) The setback for the ice machine be 21 feet from the rear property line. (c) That Mr. Medeiros enter into an agreement with the City deferring his obligation to replace the sidewalk and driveway to his parking lot(except for existing hazardous areas) for two years; (d) That the development be substantially as shown on the site plan and elevations, Exhibit A, on file with the Planning Department. (e) That approval of this case be conditioned upon approval of Case Z-76-110 by Design Review Board. (f) That all utilities to serve the ice machine be constructed underground. (g) That the emergency number of the Fire Department be posted near all telephones on the site. (h) That the smaller ice machine now located adjacent to the liquor store building be removed prior to operation of the larger machine. (i) That because it is damaged and a hazard to the public, the approximately 25 linear feet of curb, gutter and sidewalk located between the northern edge of the driveway and the northern property line of the subject property be replaced. (j) That the existing storm drainage catch basin at the entrance drive be repaired or replaced, a grate added and the drain pipe to the curb cleaned out. Section 2. This resolution shall become effective immediately upon its passage and adoption.
