CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 76-218 <br /> <br />A RESOLUTION APPROVING PAYMENT TO MORRISON HOMES THE <br />AMOUNT OF $80,491.19 <br /> <br />WHEREAS, the City of Pleasanton was sued by Morrison Homes, Inc. <br /> in August, 1973, for breach of contract for failure to <br /> provide sewer connections under the terms of certain <br /> <br /> annexation agreements executed between 1963 and 1967; and <br /> <br />WHEREAS, after trial of this matter before the Honorable Robert <br /> Kroninger, a judgment was rendered against the City of <br /> Pleasanton; and <br /> <br />WHEREAS, subsequent to the rendition of this judgment, the City of <br /> Pleasanton appealed Judge Kroninger's decision to the <br /> Appellate Courts; and <br /> <br />WHEREAS, the Appellate Courts sustained the decision of Judge <br /> <br /> Kroninger; and <br /> <br />WHEREAS, Morrison Homes has submitted to the City of Pleasanton a <br /> bill for damages, plus interest and costs for said lawsui:; <br /> an~ <br />WHEREAS, said costs bill has been reviewed by the City of Pleasanton <br /> <br /> staff to insure that it is correct; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1.
