WHEREAS, the Planning Commission held a public hearing at <br /> which time they considered a staff report of July 14, <br /> 1976 regarding Use Permit No. 76-19 and a Design Re- <br /> view Board staff report of July 14, 1976 regarding <br /> Z-76-120, together with testimony provided at the <br /> public hearing both for and against the proposed pro- <br /> ject; and <br /> <br />WHEREAS, after the close of the public hearing and deliberation <br /> by the Planning Commission upon the evidence submitted <br /> to it, the Planning Commission adopted Resolution <br /> No. 1452 ( A Resolution of the Planning Commission <br /> Affirming the Conditions for Approval for Design Re- <br /> view and Conditional Use Permit Modification for the <br /> Pleasanton Body Shop at 4262 Stanley Blvd., Pleasanton) <br /> which set forth the required findings for the granting <br /> of a conditional use permit and subjected UP-76-19 and <br /> Z-76-120 to ten (10) conditions; and <br /> <br />WHEREAS, within the appeal period established by the Zoning <br /> Code of the City of Pleasanton, an appeal was filed <br /> by Mr. Lee Amaral on behalf of Messieurs Daniel Ponds <br /> and George Garibaldi; and <br /> <br />WHEREAS, said appeal to UP-76-19 and Z-76-120 was brought to <br /> the City Council at its meeting of November 8, 1976, <br /> at which time a public hearing was held by the City <br /> Council for the purpose of taking testimony from the <br /> appellant and any member of the public desiring to <br /> address the City Council on this particular matter; <br /> and <br /> <br />WHEREAS, at the time of consideration of said appeal, the City <br /> Council had before it a memorandum of November 3, 1976 <br /> from the Director of Planning together with a copy of <br /> Resolution No. 1452 from the Planning Commission, a <br /> <br /> Copy Of the staff reports to the Planning Commission <br /> and Design Review Board dated July 14, 1976, a portion <br /> <br />-2- <br /> <br /> <br />
