Planning Commission Resolution No. 1454; and <br /> <br />WHEREAS, the City Council held a public hearing at which time <br /> the applicant and any other interested member of the <br /> public was offered the opportunity to present evidence <br /> <br /> regarding this rezoning request to the City Council; and <br /> <br />WHEREAS, subsequent to the closing of the public hearing the City <br /> Council considered the evidence presented to it, the <br /> documents submitted by the staff and discussed the pros <br /> and cons of the application in order to determine what <br /> action would be best to insure that the property de- <br /> velops in the best interest of the public health, safety <br /> and welfare; and <br /> <br />WHEREAS, it is the consensus of the City Council that the property <br /> should be rezoned from zoning district C-N and PUD to <br /> Planned Unit Development on the entire 14 acre parcel <br /> in order to provide greater control for the development <br /> of the property; and <br /> <br />WHEREAS, the City Council was advised by the City Attorney that <br /> it would be necessary to return this item to the Plan- <br /> ning Commission for further consideration since the <br /> City Council was considering a course of action not <br /> recommended by the Planning Commission in Resolution <br /> No. 1454. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE AS FOLLOWS: <br /> <br />Section 1. Indicates its intention to consider the rezoning of <br /> approximately 14 acres of property belonging to H. C. <br /> Elliott, Inc., located east of Pico Avenue between <br /> Tawny Drive and Palomino Drive from C-N and PUD (RM- <br /> 2500) to PUD, subject to the following conditions: <br /> <br /> 1. That only a maximum of 6.4 acr~ of the project may <br /> develop under a residential zoning classification. <br /> 2. That the project should be developed in phases <br /> under the Planned Unit Development District and the <br /> first phase of that development should be the commercial <br /> <br /> -2- <br /> <br /> <br />
