WHEREAS, <br /> <br />~EREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />~-IEREAS, <br /> <br />CiTY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 76-275 <br /> <br />A RESOLUTION APPROVING THE APPEAL OF THE DECISION OF THE <br />CITY ~a/NAGER TO FILE A NEGATIVE DECLARATION FOR A PROPOSED <br />RETAIL CENTER ON A SITE NORTH OF THE INTERSECTION OF SANTA <br />RITA ROAD AND TASSAJARA ROAD (CASES Z-76-200 and UP-76-29) <br /> <br /> on October 22, 1976 the City Manager signed a "Notice <br /> of Intent to File a Negative Declaration--Project <br /> designation: Z-76-200, UP-76-29" relating to the <br /> construction of a neighborhood retail center, including <br /> convenience market with gas sales, on property located <br /> immediately north of the intersection of Santa Rita <br /> <br /> Road and Tassajara Road; and <br /> <br /> said decision was appealed within the time provided for <br /> in the City of Pleasanton Environmental Impact Guide- <br /> lines and Procedures; and <br /> on November 22, 1976 this matter was scheduled for a <br /> public hearing before the City Council but was continued <br /> at the request of the property owner and with the con- <br /> currence of the appellants; and <br /> on December 6, 1976 a public hearing on said appeal <br /> was heard by the City Council~ and <br /> the appellant, ~ all other interested members of the <br /> publicswere afforded an op[~ortunity to speak in favor <br /> and against the appeal; and <br /> at the conclusion of the public hearing the City Council <br /> deliberated upon the appeal, considering the testimony <br /> provided by the public, as well as the staff report <br /> of December 1, 1976 and exhibits attached thereto. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OFTHE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. Grants the appeal from the decision of the City <br /> <br /> Manager to file a Negative Declaration for a propesed <br /> <br /> <br />
