WHEREAS, ~EREAS, WHEREAS, WHEREAS, WHEREAS, ~-IEREAS, CiTY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 76-275 A RESOLUTION APPROVING THE APPEAL OF THE DECISION OF THE CITY ~a/NAGER TO FILE A NEGATIVE DECLARATION FOR A PROPOSED RETAIL CENTER ON A SITE NORTH OF THE INTERSECTION OF SANTA RITA ROAD AND TASSAJARA ROAD (CASES Z-76-200 and UP-76-29) on October 22, 1976 the City Manager signed a "Notice of Intent to File a Negative Declaration--Project designation: Z-76-200, UP-76-29" relating to the construction of a neighborhood retail center, including convenience market with gas sales, on property located immediately north of the intersection of Santa Rita Road and Tassajara Road; and said decision was appealed within the time provided for in the City of Pleasanton Environmental Impact Guide- lines and Procedures; and on November 22, 1976 this matter was scheduled for a public hearing before the City Council but was continued at the request of the property owner and with the con- currence of the appellants; and on December 6, 1976 a public hearing on said appeal was heard by the City Council~ and the appellant, ~ all other interested members of the publicswere afforded an op[~ortunity to speak in favor and against the appeal; and at the conclusion of the public hearing the City Council deliberated upon the appeal, considering the testimony provided by the public, as well as the staff report of December 1, 1976 and exhibits attached thereto. NOW, THEREFORE, THE CITY COUNCIL OFTHE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1. Grants the appeal from the decision of the City Manager to file a Negative Declaration for a propesed
