WHEREAS, any other member of the public was afforded an op- <br /> portunity to speak at said public hearing; and <br /> <br />WHEREAS, at the conclusion of the public hearing the City <br /> Council deliberated upon the information submitted to <br /> the City Council by Mr. Joyce (Exhibits I-A, I-B, I-C, <br /> I-D and an unidentified map entitled - Remaining Air <br /> and Light Space) together with a staff report of <br /> November 17, 1976 and attachments thereto; and <br /> <br />WHEREAS, the City Council was informed by the City Attorney of <br /> the findings required to be made by the City Council <br /> if it should decide to approve the appeal by Gerald <br /> P. Joyce, said findings being more specifically set <br /> forth in Section 2-11.29, Article 26, Chapter 2, <br /> Title II of the Ordinance Code of the City of <br /> Pleasanton. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE AS FOLLOWS: <br /> <br /> Section t. Denies the appeal of Gerald Joyce to a decision of <br /> the Board of Adjustment denying case V-76-12, to allow <br /> the construction of a family room which would encroach <br /> into the required rear yard of property located at <br /> 2589 Via Espada in the City of Pleasanton. <br /> <br /> Section 2. In making its decision, the City Council considered <br /> the findings required by Section 2-11.29, Article 26, <br /> Chapter 2, Title II of the Ordinance Code of the City <br /> of Pleasanton and the determinations of the Planning <br /> Commission set forth in Resolution No. R-76-13 and <br /> determines that it cannot make the findings required <br /> by the City's Ordinance Code and incorporates by refer- <br /> ence the conclusions reached by the Planning Commission <br /> in the aforementioned resolution, attached hereto as <br /> Exhibit A and incorporated herein by reference. <br /> <br />-2- <br /> <br /> <br />
