WHEREAS, <br /> <br />WHEREAS, <br /> <br /> CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 76-267 <br /> <br />A RESOLUTION DENYING THE APPEAL OF GERALD <br />JOYCE TO A DECISION OF THE BOARD OF ADJUST- <br />MENT DENYING CASE V-76-12, AN APPLICATION <br />FOR A VARIANCE TO ALLOW THE CONSTRUCTION <br />OF A FAMILY ROOM. <br /> <br />on October 13, 1976 the Board of Adjustment for the <br /> <br />City of Pleasanton denied case V-76-17, an application <br />by Gerald P Joyce for a variance from the requirements <br />of the City's Zoning Code to allow the construction of <br />a family room which would encroach into the rear yard <br /> <br />of property located at 2589 Via Espada; and <br /> <br />the basis for the Planning Commission's determination <br /> <br />was more particularly set forth in Resolution No. <br /> <br />R-76-13 (A Resolution of the Board of Adjustment Deny- <br />ing the Request of Gerald Joyce for a Variance to Con- <br />struct a Room which Would Encroach into the Rear Set- <br />back of a Home at 2589 Via Espada); and <br /> <br />WHEREAS, the Planning Commission's resolution set forth with <br /> particularity thegrounds upon which it could not make <br /> the necessary findings in order to allow a variance to <br /> the City's Ordinance Code; and <br /> <br />WHEREAS, the decision of the Board of Adjustment was appealed <br /> by Mr. Gerald P. Joyce to the City Council for its <br /> consideration; and <br /> <br />WHEREAS, the City Council at its meeting of November 22, 1976 <br /> considered said appeal by Gerald P. Joyce and held a <br /> public hearing on said appeal; and <br /> <br />WHEREAS, Mr. Joyce was afforded the opportunity during said <br /> public hearing to present any and all information to <br /> the City Council justifying the need for a variance to <br /> the Ordinance Code; and <br /> <br /> <br />
