at 3420 Stanley Boulevard should become different <br /> from the ownership of the property on which the <br /> existing holding tank is located (A & R Service <br /> Center property). Said holding tank agreement is <br /> to be completed and executed prior to completion <br /> and occupancy of the development proposed on the <br /> subject site. <br /> <br /> 3. The applicant in the development of his property <br /> at 3420 Stanley Boulevard shall work with City <br /> Staff and indicate an appropriate site for the lo- <br /> cation of a holding tank at the 3420 Stanley Bou- <br /> levard site which can be used should the ownership <br /> of the properties in question change, and the <br /> property located at 3420 Stanley Boulevard is re- <br /> quired to install its own holding tank. The de- <br /> veloper shall not place any structures or improve- <br /> ments on the area designated as an appropriate site <br /> for a holding tank at 3420 Stanley Boulevard which <br /> in the opinion of the Director of Engineering Ser- <br /> vices would interfere with the potential use of <br /> said area for the construction of a holding tank. <br /> The owner shall obtain the written permission of <br /> the Director of Engineering Services for any im- <br /> provements to be constructed in the future holding <br /> tank area before a building permit may be obtained. <br /> <br />4. The developer recognizes that the approval of a <br /> holding tank permit by the City Council does not <br /> guarantee any sewage capacity at the Sunol Sewage <br /> Treatment Plant to the property in question, and <br /> the City has made no commitment regarding when the <br /> property in question will be allowed to terminate <br /> its holding tank services and connect to the City's <br /> sewage treatment facility. Owner recognizes that <br /> the proper~ in question is not located adjacent to <br /> <br />-2- <br /> <br /> <br />
