WHEREAS, <br /> <br />WHEi~AS~ <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br /> CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 76-289 <br /> <br />A RESOLUTION EXEMPTING FROM THE REQUIREMENTS OF GOVERNMENT <br />CODE SECTION 65402(a) PROPERTY ACQUISITIONS FOR STREET <br />WIDENING AND ALIGNMENT PROJECTS WHICH ARE OF A MINOR <br />NATURE. <br /> <br /> Government Code ~65402(a) requires a report from the <br /> Planning Commission as to conformance with the General <br /> Plan whenever real property is acquired, disposed of, <br /> vacated or abandoned; and <br /> <br /> ~65402(a) allows a legislative body by ordinance or <br /> resolution to exempt from the provisions of said section <br /> (1) the disposition of the remainder of a larger parcel <br /> which was acquired and acquired in part for street pur- <br /> poses; (2) acquisitions, dispositions, or abandonments <br /> for street widening; or (3) alignment projects, provided <br /> such dispositions for street purposes, acquisitions~ <br /> dispositions, or abandonments for street widening or <br /> alignments are of a minor nature; and <br /> the Planning Commission at its meeting of November 10, <br /> 1976, considered sLaff report from the Director of Engi- <br /> neering Services dated October 7, 1976 regarding the <br /> exemption from the reporting requirements of ~65402(a) <br /> certain activities undertaken by the City which fall <br /> within the allowable exemption set forth in the above <br /> Government Code sectionr and <br /> the Planning Commission adopted Resolution No. 1471 (A <br /> Resolution of the Planning Commission of the City of <br /> PleaSantOn Recommending to the City Council That Certain <br /> Acquisitions and Disposals of Public Property be Exempt <br /> from being Found to be in Conformity with the General <br /> Pla~; and <br /> the City Council, at its meeting of December 13, 1976, <br /> considered a report from the City Attorney's office of <br /> <br /> <br />
