WHEREAS, WHEi~AS~ WHEREAS, WHEREAS, WHEREAS, CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 76-289 A RESOLUTION EXEMPTING FROM THE REQUIREMENTS OF GOVERNMENT CODE SECTION 65402(a) PROPERTY ACQUISITIONS FOR STREET WIDENING AND ALIGNMENT PROJECTS WHICH ARE OF A MINOR NATURE. Government Code ~65402(a) requires a report from the Planning Commission as to conformance with the General Plan whenever real property is acquired, disposed of, vacated or abandoned; and ~65402(a) allows a legislative body by ordinance or resolution to exempt from the provisions of said section (1) the disposition of the remainder of a larger parcel which was acquired and acquired in part for street pur- poses; (2) acquisitions, dispositions, or abandonments for street widening; or (3) alignment projects, provided such dispositions for street purposes, acquisitions~ dispositions, or abandonments for street widening or alignments are of a minor nature; and the Planning Commission at its meeting of November 10, 1976, considered sLaff report from the Director of Engi- neering Services dated October 7, 1976 regarding the exemption from the reporting requirements of ~65402(a) certain activities undertaken by the City which fall within the allowable exemption set forth in the above Government Code sectionr and the Planning Commission adopted Resolution No. 1471 (A Resolution of the Planning Commission of the City of PleaSantOn Recommending to the City Council That Certain Acquisitions and Disposals of Public Property be Exempt from being Found to be in Conformity with the General Pla~; and the City Council, at its meeting of December 13, 1976, considered a report from the City Attorney's office of
