CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 77-22 <br /> <br />A RESOLUTION APPROVING AN APPLICATION FOR A HOLDING <br />TANK FOR PROPERTY LOCATED AT 3675 SANTA RITA ROAD <br /> <br />WHEREAS, <br /> <br />the Planning Commission and Design Review Board, at a <br />meeting of December 8, 1976, approved design review and <br />gave conditional use approval to the construction and use <br />of a second building for commercial service purposes at <br />3675 Santa Rita Road, said property being owned by <br />Mr. Earl Adams; and <br /> <br />WHEREAS~ <br /> <br />due to the lack of sewer availability to serve the proper- <br />ty owned by Mr. Adams it is necessary for him to make <br />application to the City Council for a holding tank pur- <br />suant to the City Council's policy as set forth in <br />Resolution No. 73-140; and <br /> <br />WHEREAS, <br /> <br />a previous request for a holding tank on the aforementioned <br />property had been granted by the City Council on March <br />1975, said holding tank having a capacity of 5,000 gallons; <br />and <br /> <br />WHEREAS, <br /> <br />according to records retained by the City of Pleasanton <br />only approximately one-half of the 5,000 gallons of the <br />existing holding tank is being used per month, thus indi- <br />cating the existence of adequate capacity to serve the <br />proposed new development by use of the same holding tank <br />as presently exists; and <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of January 24, 1977~ <br />considered a report from the Director of Engineerin9 <br />Services dated January 17, 1977, together with attach.-- <br />ments thereto pertaining to a request for a holding tank <br />at 3675 Santa Rita Road; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWs: <br /> <br />Section 1. Approves the application of Earl Adams for the estab- <br /> lishment of a holding tank at 3675 Santa Rita Road, <br /> subject to the following conditions: <br /> <br />(1) <br /> <br />that the use of the existing tank at 3675 Santa Rita <br />Road be considered satisfactory only so long as the <br />parcel containing the two structures to be served by <br />said holding tank remai~ as a single parcel of land. <br /> <br />(2) <br /> <br />the property owner shall enter a holding tank agree- <br />ment with the City of Pleasanton for the use of the <br />existing holding tank by the proposed second commer- <br />cial building to be located at 3675 Santa Rita Road. <br />Said agreement shall be automatically terminated in <br /> <br /> <br />
