MODIFICATION TO ANNEXATION AGREEMENT <br /> <br />THIS MODIFICATION AGREEMENT made and entered into this <br />day of March, 1977 by and between the City of Pleasanton, a <br />municipal corporation, (hereinafter referred to as "City") and the <br />Morris Stulsaft Testamentary Trust, successor in interest in Land <br />Development and Investment Company under that certain annexation <br />agreement dated May 6, 1963 and a party to that certain modification <br />agreement dated September 30, 1973, modifying said annexation agree- <br />ment, (hereinafter referred to as "Owner"). <br /> <br />WITNESSETH <br /> <br /> WHEREAS, Owner's predecessor and City entered into an <br />annexation agreement, dated May 6~ 1963, with respect to certain <br />therein described land within the City; and <br /> <br /> 'WHEREAS, Owner and City entered into a modification of said <br />annexation agreement dated September 30, 1973, regarding transfer <br />by Owner to City of land for park purposes and installation by City, <br /> <br /> of Street improvements adjacent to said park; <br /> <br />in return therefor, <br />and <br /> <br /> VqHEREAS~ <br /> <br /> Owner has submitted a minor subdivision map to City <br />(MS-76-14) to divide Owner's property into four fifteen (15) acre <br />parcels; and <br /> <br /> WHEREAS, due to the proposed division contemplated by <br />MS-76-14 Owner and City wish to clarify the aforementioned modification <br />as it relates to installation of street improvements and to modify <br /> <br /> <br />
