CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-99 <br /> <br />A RESOLUTION ADOPTING A PAY-AS-YOU-GO ALTERNATE <br />MEANS OF FINANCING FOR THE CITY OF PLEASANTON'S <br />PORTION OF LAVWMA PROJECT 1B-O <br /> <br />WHEREAS, <br /> <br />the Livermore-Amador Valley Water Management Agency is a <br />joint powers agency created by the City of Livermore, City <br />of Pleasanton and the Valley Community Services District <br />in order to implement a waste water disposal system for <br />the Livermore-Amador Valley; and <br /> <br />WHEREAS, <br /> <br />the Livermore-Amador Valley Water Management Agency's <br />Board of Directors at a special meeting held on March 30, <br />1977 selected Alternative 1B-O (Boehmer Summit - EBDA <br />Interceptor with No Demineralization and with Nominal Re- <br />use) as the most cost effective project to qualify for <br />State and Federal funding; and <br /> <br />WHEREAS, <br /> <br />the Livermore-Amador Valley Water Management Agency's <br />Board of Directors also determined at said meeting to pro- <br />ceed with financing the above mentioned project by use of <br />the Revenue Bond Law of 1941, specifically Government Code <br />Section 54307.1(b), which authorizes the issuance of 1941 <br />revenue bonds without voter approval but subject to refer- <br />endum; and <br /> <br />WHEREAS, <br /> <br />in order for LAVWMA to qualify for Federal and State funding <br />of 87 1/2% of the capital cost of the 1B-O project, the total <br />capital cost of which has been estimated by CH2M Hill, engin- <br />eers for LAVWMA, to be approximately thirty-eight million <br />dollars, it is necessary that the agencies comprising LAVWMA <br />adopt a back up method of financing prior to September 30, <br />1977; and <br /> <br />WHEREAS, <br /> <br />State and Regional Representatives of the State Water Re- <br />sources Control Board have indicated to LAVWMA and its mem- <br />ber agencies that a pay-as-you-go method of financing is an <br />acceptable alternate method of financing for insuring the <br />aforementioned 87 1/2% funds will be available for the LAVWMA <br />project; and <br /> <br />WHEREAS, <br /> <br />the City of Livermore and the Valley Community Services Dis- <br />trict have indicated by various resolutions that they will <br />adopt a pay-as-you-go program as alternate means of funding <br />the LAVWMA project. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. The City Council adopts pay-as-you-go financing for the <br /> LAVWMA 1B-O project to be accomplished by an increase in the <br /> sewer service charge of an amount necessary to provide the <br /> City of Pleasanton's share of the cost for Alternative 1B-O <br /> (Boehmer Summit - EBDA Interceptor with No Demineralization <br /> and with Nominal Reuse). <br /> <br /> <br />
