(8) <br /> <br />electorate of the Agency voting on the measure. <br />Repairs and improvements necessary to keep the <br />basic project operational and future industrial <br />(including non-retail commercial) capacity <br />shall not be included in the above limitation. <br />To enter into contracts, subject to the unani- <br />mous approval of the Board of Directors, with <br />any or all of the original parties to allow <br />the purchase of any unused capacity to a total <br />of 1 MGD which may exist in the future in the <br />basic project pipeline, described in subpara- <br />graph (a) above. The City of Pleasanton shall <br />have a guaranteed option to purchase 500,000 <br />gallons per day of the aforementioned 1 MGD <br />subject to the provisions of this subparagraph. <br />The party purchasing any unused capacity shall <br />bear all costs associated with said purchase, <br />including but not limited to incremental capi- <br />tal costs, operation - maintenance costs, admin- <br />istrative costs, depreciation, capital replace- <br />ment and previous design and engineering costs. <br />Any unused capacity available in the basic <br />project shall be purchased only for industrial <br />(including non-retail commercial) purposes. <br /> <br /> It is understood between the parties that Valley <br /> Community Services District shall not be required <br /> to add any additional treatment capacity to its <br /> sewage treatment plant iF order to provide for <br /> the industrial capacity, or any portion thereof, <br /> <br /> -7- <br /> <br /> <br />
