CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-111 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />AUTHORIZING ACQUISITION OF PROPERTY, DESIGNATION OF PERSONNEL <br />TO ACCEPT DEEDS AND GRANTS ON BEHALF OF THE CITY OF PLEASANTON, <br />AND INSTITUTION OF EMINENT DOMAIN PROCEEDINGS FOR THE WESTERLY <br />19 FEET OF ALAMEDA COUNTY ASSESSOR'S PARCEL NO. 94-217-72 <br /> (1734 SANTA RITA ROAD) <br /> <br />WHEREAS, <br /> <br />Government Code Section 37350.5 authorizes a city to <br />acquire by eminent domain any property necessary to <br />carry out any of its powers and functions; and <br /> <br />WHEREAS, Government Code Section 37353 authorizes a city to acquire <br /> property for street purposes; and <br /> <br />WHEREAS, <br /> <br />the city has developed plans for the realignment of Valley <br />Avenue on the eastern side of Santa Rita Road together <br />with the widening of Santa Rita Road adjacent to the <br />alignment area for Valley Avenue; and <br /> <br />WHEREAS, <br /> <br />the acquisition of the land and property hereinafter <br />described is necessary for the aforementioned street <br />purposes; and <br /> <br />WHEREAS, there is a public need to acquire the property herein- <br /> after described; and <br /> <br />WHEREAS, <br /> <br />pursuant to Government Code Section 1245.35 notice and <br />opportunity to be heard was given to the persons shown <br />on the last equalized county assessment roll for the <br />property to be acquired herein; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE, FIND AND DETERMINE AS FOLLOWS: <br /> <br />Section 1. The public welfare, convenience, interest and neces- <br /> sity require the acquisition of a portion of the real <br /> property designated as Assessor's Parcel No. 94-217-72, <br /> as more particularly described in the property descrip- <br /> tion attached hereto as Exhibit A and incorporated herein <br /> by reference and as outlined in the map attached hereto <br /> as Exhibit B and incorporated herein by reference. <br /> <br />Section 2. The use to which the property is to be applied, to wit, <br /> street purposes, is a use authorized by Government Code <br /> Sections 37350.5 and 37353. <br /> <br />Section 3. The public interest and necessity require the proposed <br /> street project for which the property in question is a <br /> necessary part thereof so as to require acquisition by <br /> the City of Pleasanton. <br /> <br /> <br />
