CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 77-111 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING ACQUISITION OF PROPERTY, DESIGNATION OF PERSONNEL TO ACCEPT DEEDS AND GRANTS ON BEHALF OF THE CITY OF PLEASANTON, AND INSTITUTION OF EMINENT DOMAIN PROCEEDINGS FOR THE WESTERLY 19 FEET OF ALAMEDA COUNTY ASSESSOR'S PARCEL NO. 94-217-72 (1734 SANTA RITA ROAD) WHEREAS, Government Code Section 37350.5 authorizes a city to acquire by eminent domain any property necessary to carry out any of its powers and functions; and WHEREAS, Government Code Section 37353 authorizes a city to acquire property for street purposes; and WHEREAS, the city has developed plans for the realignment of Valley Avenue on the eastern side of Santa Rita Road together with the widening of Santa Rita Road adjacent to the alignment area for Valley Avenue; and WHEREAS, the acquisition of the land and property hereinafter described is necessary for the aforementioned street purposes; and WHEREAS, there is a public need to acquire the property herein- after described; and WHEREAS, pursuant to Government Code Section 1245.35 notice and opportunity to be heard was given to the persons shown on the last equalized county assessment roll for the property to be acquired herein; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, FIND AND DETERMINE AS FOLLOWS: Section 1. The public welfare, convenience, interest and neces- sity require the acquisition of a portion of the real property designated as Assessor's Parcel No. 94-217-72, as more particularly described in the property descrip- tion attached hereto as Exhibit A and incorporated herein by reference and as outlined in the map attached hereto as Exhibit B and incorporated herein by reference. Section 2. The use to which the property is to be applied, to wit, street purposes, is a use authorized by Government Code Sections 37350.5 and 37353. Section 3. The public interest and necessity require the proposed street project for which the property in question is a necessary part thereof so as to require acquisition by the City of Pleasanton.
