No. 77~!32 <br />Page Three <br /> <br />jobs for construction workers in the area and will benefit <br />the local economy; the City is obligated by the Judgment in <br />Morrison Homes Corp. v. City of Pleasanton (sustained at <br />58 Cal. App. 3d 724) to act in good faith in exercising <br />zoning, planning and subdivision powers so as not to at- <br />tempt to void the City's sewage obligations to Morrison <br />Homes. Due to the above reasons, the Council determines <br />that the project alternatives identified in the final EIR <br />are not feasible. <br /> <br />Section 6. The boundaries of the area which may be significantly <br /> affected by this project are more particularly identified <br /> in Paragraph VII of Volume II of the final Environment <br /> Report but essentially include: the Amador-Livermore Valley <br /> and the area along the Arroyo de La Laguna of Alameda Creek <br /> as far downstream as Niles. <br /> <br />Section 7. This resolution and attachments hereto shall constitute <br /> the Statement of Overriding Considerations required by <br /> Sec. 5.8 of Resolution No. 77-66. <br /> <br />Section 8. Staff is directed to prepare a Notice of Determination <br /> for filing with the proper agencies and authorities as <br /> required by Sec. 5.9 of Resolution No. 77-66. <br /> <br />Section 9. The City Clerk shall cause a copy of this resolution <br /> to be provided to any federal, state, regional or local <br /> agencies requiring or requesting the same, as well as any <br /> citizen who requests a copy. A nominal charge of ten cents <br /> ($.10) per page may be charged to non-governmental persons <br /> or entities for copies. <br /> <br />Section 10.
