WHEREAS, <br /> <br />on May 3, 1977, the General Counsel for the Livermore- <br />Amador Valley Water Management Agency transmitted to <br />the various councils and board members of said body the <br />proposed changes agreed to at the April 27, 1977 meeting; <br />and <br /> <br />WHEREAS, <br /> <br />the City Council of the City of Pleasanton approved the <br />proposed modifications at their meeting of May 9, 1977; <br />and <br /> <br />WHEREAS, <br /> <br />subsequent to said approval a minor change to Paragraph <br />Eight of said agreement was proposed by Valley Community <br />Services District; and <br /> <br />WHEREAS, said modification was discussed at the meeting of the City <br /> Council of May 23, 1977. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. The City Council reaffirms its action of May 9, 1977, <br /> approving the modifications to the Joint Exercise of Powers <br /> Agreement as proposed by the LAVWMA General Counsel which <br /> reflect the discussions of April 27, 1977. <br /> <br />Section 2. The City Council authorizes and empowers its repre- <br /> sentatives to the Livermore-Amador Valley Water Manage- <br /> ment Agency to obtain a clarification of the intent of <br /> the proposed change to Paragraph Eight, suggested by the <br /> Valley Community Services District, which would change <br /> the last sentence in the first full paragraph of Section <br /> XI A(8) on Page 7 of said modification to read as follows: <br /> <br />"It is understood between the parties that the <br />purchase of capacity in this project in no way <br />requires any discharger to provide equal treat- <br />ment plant capacity." <br /> <br />The City's LAVWMA representatives are empowered to indicate <br />the City of Pleasanton's concurrence with the modifications <br />to the Joint Exercise of Powers Agreement as originally <br />presented and as modified by Valley Community Services <br />District if in the opinion of the City's representatives <br />the modification is reasonable. <br /> <br />IIIIIIIIIIIII <br /> <br />Res, NO, 77~156 <br />Page Two <br /> <br /> <br />
