CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-156 <br /> <br />A RESOLUTION APPROVING AMENDMENTS TO THE LIVERMORE-AMADOR <br />VALLEY WATER MANAGEMENT AGENCY JOINT EXERCISE OF POWERS <br />AGREEMENT <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton is a member of the Livermore-Amador <br />Valley Water Management Agency, a Joint Exercise of Powers <br />Agency, established for the purpose of devising a plan for <br />the elimination of treated effluent from the Livermore- <br />Amador Valley; and <br /> <br />WHEREAS, <br /> <br />said Joint Exercise of Powers Agency was created on <br />January 14, 1974 by the adoption of the three participating <br />agencies (City of Livermore, City of Pleasanton and Valley <br />Community Services District) of a Joint Exercise of Powers <br />Agreement~ and <br /> <br />WHEREASt <br /> <br />subsequent to the formation of the Livermore-Amador Valley <br />Water Management Agency, the necessary studies have been <br />conducted by John Carollo Engineers and CH2M Hill with <br />respect to the most feasible method of eliminating treated <br />effluent from the Livermore-~ador Valley; and <br /> <br />WHEREAS, <br /> <br />the project proposed differs from the original project <br />contemplated at the time of the execution of the Joint <br />Exercise of Powers Agreement and it is necessary to amend <br />said agreement to reflect this project~ and <br /> <br />WHEREAS, <br /> <br />the Joint Exercise of Powers Agreement needs to be modified, <br />also, in order to reflect other changes which have occurred <br />with respect to the financing of the project as suggested <br />by Bond Counsel; and <br /> <br />WHEREAS, <br /> <br />proposed modifications have gone through some six drafts <br />since they were first discussed by the agencies comprising <br />LAVWMA beginning August 1976; and <br /> <br />WHEREAS, <br /> <br />the City Council of the City of Pleasanton has been <br />approving the various modifications to the LAVWMA Joint <br />Exercise of Powers Agreement and the expansion of the <br />project size from the original 13m.g.d. project since <br />August 1976; and <br /> <br />WHEREAS, <br /> <br />the final changes to the Livermore-Amador Valley Water <br />Management Agency Joint Exercise of Powers Agreement were <br />discussed by the Agency's Board Members and their respec- <br />tive Councils at a joint meeting held on April 27, 1977; <br />and <br /> <br /> <br />
