RES. NO. Page 2. 77-187 That applicant be advised that the staff feels that the applicant's estimate of sewage volume is low and staff estimates a monthly volume of approximate- ly 7,000 gallons. Estimated pumping and disposal charges at current rates would be approximately $500 per month but would be higher or lower depending on actual volume generated. The applicant recognizes that the approval of a hold- ing tank permit by the City Council does not guaran- tee any sewage capacity at the Valley Community Ser- vices District Treatment Plant to the property in question, and the City has made no commitment regard- ing when the property in question will be allowed to terminate its holding tank services and connect to the Valley Community Sewage Treatment Facility. Applicant recognizes that the property in question is located within an area subject to a settlement agreement, com- monly referred to as the 1972 Settlement Agreement of November 8, 1972, a copy of which is available in the City Attorney's office. Said settlement agreement es- tablishes priority rights in the Valley Community Ser- vices District Plant and any rights to connect to the Valley Community Services District Plant for appli- cant's property, will be subject to the provisions of said settlement agreement. The applicant is aware that his property will be on a holding tank for an in- determinate number of years and recognizes that the cost for removing sewage from a holding tank is an ob- ligation to be born solely by the applicant for how- ever long said property is used and is not connected to the Valley Community Services District Sewage Treat- ment Plan. Section 2. This resolution shall become effective immediately upon its passage and adoption.
