RES. NO. <br />Page 2. <br /> <br />77-187 <br /> <br />That applicant be advised that the staff feels that <br />the applicant's estimate of sewage volume is low <br />and staff estimates a monthly volume of approximate- <br />ly 7,000 gallons. Estimated pumping and disposal <br />charges at current rates would be approximately $500 <br />per month but would be higher or lower depending on <br />actual volume generated. <br /> <br />The applicant recognizes that the approval of a hold- <br />ing tank permit by the City Council does not guaran- <br />tee any sewage capacity at the Valley Community Ser- <br />vices District Treatment Plant to the property in <br />question, and the City has made no commitment regard- <br />ing when the property in question will be allowed to <br />terminate its holding tank services and connect to the <br />Valley Community Sewage Treatment Facility. Applicant <br />recognizes that the property in question is located <br />within an area subject to a settlement agreement, com- <br />monly referred to as the 1972 Settlement Agreement of <br />November 8, 1972, a copy of which is available in the <br />City Attorney's office. Said settlement agreement es- <br />tablishes priority rights in the Valley Community Ser- <br />vices District Plant and any rights to connect to the <br />Valley Community Services District Plant for appli- <br />cant's property, will be subject to the provisions of <br />said settlement agreement. The applicant is aware <br />that his property will be on a holding tank for an in- <br />determinate number of years and recognizes that the <br />cost for removing sewage from a holding tank is an ob- <br />ligation to be born solely by the applicant for how- <br />ever long said property is used and is not connected <br />to the Valley Community Services District Sewage Treat- <br />ment Plan. <br /> <br />Section 2.
