Actual Construction Costs: The figures set forth in Section I.A. costs. Any liquidated damages collected for not completing the work on time will reduce the actual construction costs accordingly. Costs for general administration, design, surveys, inspection, testing, contract administration, shop drawings reviews, and legal expenses borne by the Authority shall not be included as construction costs, but are considered as included in the 20% Indirect Cost factor agreed upon in Line 7 of Section I.A. Right of Way acquisitions resulting in recorded or deeded interests in land, and all associated costs to obtain those interests are not to be included in constructions costs. Grants and State Loans: Any state, federal or other grants received by Authority for those facilities in which Agency is participating will be credited to Agency's Share of Total # Cost in proportion to the funding agencies' determination of eligible costs .of Agency and Authority. Any grant ineligible costs identified with Agency or Authority will be paid fully by the party benefiting from the grant- ineligible facilities or capacity. Under no circumstances will the construction of grant-ineligible facilities or capacity to serve one party increase the cost to the other party. A-2
