WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 77-203 <br /> <br />APPROVAL OF PROPOSED CONTRACT BETWEEN LAVWMA AND <br />EAST BAY DISCHARGE AUTHORITY <br /> <br />the Livermore-Amador Valley Water Management Agency has <br />requested each of its participating member agencies to <br />review the proposed contract between East Bay Dischargers <br />Authority and LAVWMA in order to obtain the opinion of <br />the participating agencies with respect to said contract; <br />and <br /> <br />the pipe line project which has been selected by LAVWMA <br />over Boehmer Summit will be tying into a facility owned <br />by the East Bay Discharger Authority (EBDA), which even- <br />tually discharges to San Francisco Bay; and <br /> <br />in order to tie into the East Bay Dischargers line, it is <br />necessary for LAVWMA to enter into an agreement with East <br />Bay Dischargers Authority, which spells out the rights and <br />obligations of each of the parties; and <br /> <br />an agreement has been in the process of negotiations for <br />over one year and the document, attached hereto and incor- <br />porated herein by reference, must be approved by the LAVWMA <br />Board and the East Bay Dischargers Authority; and <br /> <br />the City Attorney has been intimately involved in the <br />negotiations regarding the contents of the agreement and <br />believes that the agreement is a fair document for both <br />sides; and <br /> <br />Mr. Gary Reiners, City Attorney of Livermore, and <br />Ms. McElligott, Attorney for Valley Community Services <br />District desire some changes to Paragraph 10, Arbitration <br />and Disputes, and Paragraph 14 which also refers to arbi- <br />tration provision set forth in Paragraph 10; and <br /> <br />in addition to a possible change in Paragraph 10, executive <br />directors for LAVWMA and EBDA are still attempting to work <br />out the exact language of Exhibit B to the agreement;and <br /> <br />the City Council at its meeting of July 25, 1977, received <br />and reviewed a report and attachments dated July 20, 1977, <br />from the City Attorney regarding the Livermore-Amador Valley <br />Water Management Agency and East Bay Dischargers Authority <br />Contract. <br /> <br />III <br /> <br /> <br />
