CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 77-278 A RESOLUTION OF THE CITY COUNCIL ESTABLISHING AN EXEMPTION PROCEDURE FOR AGENCIES OTHERWISE REQUIRED TO PROMULGATE A CONFLICT OF INTEREST CODE WHEREAS, Section 87300 of the Government Code requires every agency to adopt or promulgate a Conflict of Interest Code and submit the code to their code-reviewing body for approval; and WHEREAS, the City Council of the City of Pleasanton is the code-re- viewing body for agencies within its jurisdiction; and WHEREAS, some agencies, because of the scope of their duties may have no members or employees making or participating in govern- mental decisions; and WHEREAS, it is possible, therefore, that some agencies would be required to promulgate a Conflict' of Interest Code although none of its members or employees would be designated for disclosure under that code; and WHEREAS, the Fair Political Practices Commission in its role as code- reviewing body for state agencies has remedied this situation by establishing an exemption process by which agencies with members making or participating in governmental decisions could be relieved of the responsibility of promulgating a Conflict of Interest Code by the Fair Political Practices Commission; and WHEREAS, it is likely that the City of Pleasanton may have some agencies which would fall into the above described category. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Pleasanton acting in its capacity as code-reviewing body for the various local agencies within its jurisdiction adopts the following regulation: Exemption From Promulgating Conflict of Interest Codes An agency may submit a request to the City Council for exemption frc~the provisions of Government Code Section 87300 requiring adop- tion and promulgation of a Conflict of Interest Code by each agency. An exemption shall be granted if the City Council concludes that there are no positions within the agency which involve the making or participating in the making of governmental decisions which may foreseeably have a material effect on any financial interest.
