CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-278 <br /> <br />A RESOLUTION OF THE CITY COUNCIL ESTABLISHING AN EXEMPTION <br />PROCEDURE FOR AGENCIES OTHERWISE REQUIRED TO PROMULGATE A <br />CONFLICT OF INTEREST CODE <br /> <br />WHEREAS, <br /> <br />Section 87300 of the Government Code requires every agency <br />to adopt or promulgate a Conflict of Interest Code and submit <br />the code to their code-reviewing body for approval; and <br /> <br />WHEREAS, the City Council of the City of Pleasanton is the code-re- <br /> viewing body for agencies within its jurisdiction; and <br /> <br />WHEREAS, <br /> <br />some agencies, because of the scope of their duties may have <br />no members or employees making or participating in govern- <br />mental decisions; and <br /> <br />WHEREAS, <br /> <br />it is possible, therefore, that some agencies would be <br />required to promulgate a Conflict' of Interest Code although <br />none of its members or employees would be designated for <br />disclosure under that code; and <br /> <br />WHEREAS, <br /> <br />the Fair Political Practices Commission in its role as code- <br />reviewing body for state agencies has remedied this situation <br />by establishing an exemption process by which agencies with <br />members making or participating in governmental decisions <br />could be relieved of the responsibility of promulgating a <br />Conflict of Interest Code by the Fair Political Practices <br />Commission; and <br /> <br />WHEREAS, it is likely that the City of Pleasanton may have some agencies <br /> which would fall into the above described category. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1. The City Council of the City of Pleasanton acting in its <br /> capacity as code-reviewing body for the various local agencies <br /> within its jurisdiction adopts the following regulation: <br /> <br />Exemption From Promulgating Conflict of Interest Codes <br /> <br />An agency may submit a request to the City <br />Council for exemption frc~the provisions of <br />Government Code Section 87300 requiring adop- <br />tion and promulgation of a Conflict of Interest <br />Code by each agency. <br /> <br />An exemption shall be granted if the City <br />Council concludes that there are no positions <br />within the agency which involve the making <br />or participating in the making of governmental <br />decisions which may foreseeably have a material <br />effect on any financial interest. <br /> <br /> <br />
