CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-269 <br /> <br />A RESOLUTION APPROVING A NEGATIVE DECLARATION FOR <br />REZONING APPLICATION PUD-77-6 (DATWYLER PROPERTY) <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of October 11, 1977, re- <br />ceived a proposed Negative Declaration for the rezoning of <br />approximately a 2.56 acre parcel of land located between <br />the Arroyo del Valle and the future Del Valle Parkway, <br />roughly 1600 feet east of Hopyard Road from the RM-2000 <br />(Multiple Family Residential) District to the PUD (Planned <br />Unit Development) District and to approve a development <br />plan for the construction of 22-unit two-story townhouses <br />immediately to the west of the existing single family resi- <br />dents on the lot; and <br /> <br />the Planning Commission, at its meeting of September 14, 1977, <br />recommended to the City Council the adoption of a Negative <br />Declaration; and <br /> <br />the recommendation for a Negative Declaration was based upon <br />an Initial Study done pursuant to the Environmental Impact <br />Guidelines and Processing Procedures adopted by the City <br />Council of the City of Pleasanton by Resolution No. 77-66; <br />and <br /> <br />the City Council, at its meeting of October 11, 1977, received <br />the Initial Study and the proposed Negative Declaration in a <br />report from the Director of Planning dated September 15, 1977 <br />regarding the proposed rezoning; and <br /> <br />the City Council was advised by the City Attorney of its re- <br />sponsibilities reviewing the proposed Negative Declaration <br />and the determinations required by Section 5.4(e) of Resolu- <br />tion No. 77-66; and <br /> <br />each member of the City Council had before them copies of <br />Resolution No. 77-66 at the time of considering the proposed <br />Negative Declaration and Initial Study; and <br /> <br />the public was afforded an opportunity to comment on the pro- <br />posed environmental assessment, which had previously been pub- <br />lished in the Pleasanton Times, at the time of the public hear- <br />ing on the rezoning proposal; and <br /> <br />upon receipt of the staff report and public input, the City <br />Council reviewed the provisions of the City's Guidelines and <br />Processing Procedures for the evaluation of projects and the <br />preparation of Environmental Impact Reports as they pertain <br />to requirements for Negative Declarations and Environmental <br />Impact Reports in order to determine if a Negative Declara- <br />tion is appropriate for the project and what mitigation mea- <br />sures, if any, must be undertaken to ensure that the project <br />will not have a significant impact upon the environment. <br /> <br /> <br />
