CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 77-269 A RESOLUTION APPROVING A NEGATIVE DECLARATION FOR REZONING APPLICATION PUD-77-6 (DATWYLER PROPERTY) WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, the City Council, at its meeting of October 11, 1977, re- ceived a proposed Negative Declaration for the rezoning of approximately a 2.56 acre parcel of land located between the Arroyo del Valle and the future Del Valle Parkway, roughly 1600 feet east of Hopyard Road from the RM-2000 (Multiple Family Residential) District to the PUD (Planned Unit Development) District and to approve a development plan for the construction of 22-unit two-story townhouses immediately to the west of the existing single family resi- dents on the lot; and the Planning Commission, at its meeting of September 14, 1977, recommended to the City Council the adoption of a Negative Declaration; and the recommendation for a Negative Declaration was based upon an Initial Study done pursuant to the Environmental Impact Guidelines and Processing Procedures adopted by the City Council of the City of Pleasanton by Resolution No. 77-66; and the City Council, at its meeting of October 11, 1977, received the Initial Study and the proposed Negative Declaration in a report from the Director of Planning dated September 15, 1977 regarding the proposed rezoning; and the City Council was advised by the City Attorney of its re- sponsibilities reviewing the proposed Negative Declaration and the determinations required by Section 5.4(e) of Resolu- tion No. 77-66; and each member of the City Council had before them copies of Resolution No. 77-66 at the time of considering the proposed Negative Declaration and Initial Study; and the public was afforded an opportunity to comment on the pro- posed environmental assessment, which had previously been pub- lished in the Pleasanton Times, at the time of the public hear- ing on the rezoning proposal; and upon receipt of the staff report and public input, the City Council reviewed the provisions of the City's Guidelines and Processing Procedures for the evaluation of projects and the preparation of Environmental Impact Reports as they pertain to requirements for Negative Declarations and Environmental Impact Reports in order to determine if a Negative Declara- tion is appropriate for the project and what mitigation mea- sures, if any, must be undertaken to ensure that the project will not have a significant impact upon the environment.
