WHEREAS, <br /> <br />WHEREAS , <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />BOARD OF ADJUSTMENT <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. R-77-14 <br /> <br />A RESOLUTION OF THE BOARD OF ADJUSTMENT OF THE CITY <br />OF PLEASANTON DENYING V-77-13 FILED BY CHRIS BERATLIS <br /> <br />Chris Beratlis applied for a variance to Section 2-5.35 of <br />Article 3, and Section 2-9.16 of Article 16, Chapter 2, <br />Title II of the Ordinance Code of the City of Pleasanton <br />to allow construction of an addition to the existing office <br />building at 287 Bernal Avenue, which would encroach into <br />the required side yard and which would have less parking <br />than required by the Code; and <br /> <br />the zoning for the property is O (Office) District; and <br /> <br />a public hearing was held on September 14, 1977, to review <br />this request, at which time all maps, documents, testmimony <br />and reports were reviewed; and <br /> <br />the Board of Adjustment made the findings: <br /> <br />That the property is being used at its maximum capacity <br />considering its size and its Office district designation <br />and already is marked by a substantial non-conforming <br />condition and, therefore, the strict application of <br />the provisions of the Code does not deny this property <br />of privileges enjoyed by other similarly zoned proper- <br />ties in the vicinity. <br /> <br />The granting of the variance requested would amount to <br />a grant of special privilege inconsistent with the <br />limitations on other similarly zoned properties in that <br />other substandard size lots in the Office district must <br />adhere to district regulations; and <br /> <br />The granting of the variance, however, need not neces- <br />sarily be detrimental to the public health, safety and <br />welfare nor injurious to other properties or improvements <br />in the area. <br /> <br />With respect to parking: <br /> <br />Existing and future traffic volumes along Bernal Avenue <br />and the parking demand that could reasonably be expected <br />by uses on the site require strict and literal interpre- <br /> <br />-1- <br /> <br />EXHIBIT "A" TO CITY COUNCIL <br /> RES.
