WHEREAS, <br /> <br />the State Water Resources Control Board has previously determined <br />to withhold the grant offer for the interceptor until the City and <br />Dublin-San Ramon Services District have reached agreement concerning <br />the expansion and use of the Dublin-San Ramon Services District Plant <br />to serve the Sunol Boulevard Plant service area; and <br /> <br />WHEREAS, <br /> <br />the City and Dublin-San Ramon Services District have been negotiating <br />in good faith to allow a consolidation of treatment facility but a <br />mutually satisfactory agreement has not been negotiated; and <br /> <br />the City intends to continue to negotiate an agreement with District <br />but it must be recognized that the possibility exists that consummating <br />such an agreement may still take considerable time and may in fact not <br />be possible; and <br /> <br />WHEREAS, <br /> <br />the interceptor sewer is a necessary link in the City's sewage system <br />and will be required by and is consistent with any alternative that <br />may ultimately emerge regarding sewerage services in the Sunol area; <br />and <br /> <br />minor changes in the end points of the interceptor would allow the <br />City to make use of the interceptor to convey treated sewage from the <br />Sunol Boulevard Plant to the LAVWMA disposal system; and <br /> <br />if the City retains sewerage capabilities due to inability to reach <br />a reasonable agreement with Dublin-San Ramon Services District, an <br />interceptor would be necessary for at least the disposal of excess <br />flows in the rainy season for the City's existing irrigation method <br />of effluent disposal and would allow a more efficient irrigation <br />program, and precluding the possibility of runoff which is prohibited <br />by the Regional Board; and <br /> <br />WHEREAS, construction costs for the interceptor sewer are constantly rising. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS <br />FOLLOWS: <br /> <br />Section 1. The City Council urges the State Water Resources Control Board to <br /> take whatever steps as are necessary to allow the immediate construc- <br /> tion of the Interceptor Sewer without requiring that agreement be <br /> reached between the City and Dublin-San Ramon Services District. <br /> <br />Section 2. The City Council urges the State Water Resources Control Board to <br /> approve minor changes in the end points of the Interceptor Sewer and <br /> to approve the use of the Interceptor Sewer to carry treated sewage <br /> from the Sunol Boulevard Plant to the LAVWMA system. <br /> <br />Section 3. The City Council will continue to negotiate with Dublin-San Ramon <br /> Services District in an effort to reach a reasonable and equitable <br /> agreement, but recognizes its responsibility to meet the sewer service <br /> needs of the Sunol area by alternate methods identified in Resolution <br /> No. 74-212, a resolution selecting the best apparent project from <br /> Alternate 2-B (Interceptor Sewer Line) and Alternative 5-b (Construc- <br /> tion of New Sewer Plant) and requesting funding of the most apparent <br /> project subject to conditions. <br /> <br /> <br />
