S~ zial assessment proceedino will be initiated, <br />necessary hearings will be held thereon and, provided the City Council of <br /> <br />Cit], at the time of said hearings determines that the proceedings should <br />go fon~,ard and assessments be levied in accordance with benefit, the <br />Engineer's Report will be adopted and the assessments will be levied. <br />No recordation of the assessment liens will occur until satisfaction <br />of all of the conditions set forth below in Paragraph III-D-1, provided <br /> <br /> assessment liens for Assessment District No. 1974-1 for <br /> <br /> recorded when ready without being <br /> <br /> 2. No improvements to the Shopping Center shall be planned, <br /> designed or paid for as part of,the special assessment proceedings, <br /> including, but not limited to, any plans of Developer for such Shopping <br /> Center which shall include sidewalks, truck ramps for loading and unloading, <br /> co~on areas of access for traffic within said Shopping Center or any <br /> other improvement to the Shopping Center other'than the grading thereof, <br /> which will be necessitated by reason of the grading, filling and develop- <br /> ment of collateral roads. The Engineer Of Work, however, will coordinate <br /> his grading plan, the size and dimensions thereof~ utility facilities for <br /> com=mon use of the Shopping Center and the public, storm sewers including <br /> drains, surface drainage installations in the parking lot, sanitary sewers, <br /> including taps for connecting to private property, with the plans for <br /> design and engineering of Shopping Center. <br /> <br /> D. Procedures subsequent to levy of assessments: <br /> <br /> 1. Timing for creation of lien of assessment. <br /> When the Developer has acquired title to Shopping Center <br /> -7- <br /> <br /> <br />
