CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 78-132 <br /> <br />A RESOLUTION REVERSING THE DECISION OF THE PLANNING <br />COMMISSION THAT WOULD HAVE GRANTED A CONDITIONAL USE <br />PERMIT TO WICKLAND OIL COMPANY FOR A GAS STATION AT <br />HOPYARD ROAD AND JOHNSON INDUSTRIAL DRIVE <br /> <br />WHEREAS, <br /> <br />the Planning Commission, on April 19, 1978, considered and <br />approved application UP-78-6 for a Conditional Use Permit <br />for Wickland Oil Company's proposed gas station project at <br />the 1.1 acre site at the northwest corner of Hopyard Road <br />and Johnson Industrial Drive; and <br /> <br />WHEREAS, <br /> <br />the Design Review Board granted design approval for the <br />project on April 19, 1978; and <br /> <br />WHEREAS, <br /> <br />pursuant to Section 2-11.10 of the Pleasanton Ordinance <br />Code, Frank C. Brandes appealed the Planning Commission's <br />decision to the City Council; and <br /> <br />WHEREAS, <br /> <br />Wickland Oil Company, the <br />the Planning Commission's <br />and <br /> <br />applicant, appealed several of <br />conditions of approval to UP-78-6; <br /> <br />WHEREAS, the appeals were consolidated and scheduled for City Council <br /> hearing on April 25, 1978; and <br /> <br />WHEREAS, <br /> <br />the City Council opened the public hearing and continued <br />the matter to May 23, 1978 at the request of the applicant, <br />Wickland Oil Company; and <br /> <br />WHEREAS, the hearing was reopened on May 23, 1978 and testimony was <br /> taken; and <br /> <br />WHEREAS, <br /> <br />the City Council adopted Resolution No. 78-131 making the <br />finding that subtantial adverse environmental impacts would <br />be likely if the project were approved, a negative declara- <br />tion was not appropriate, even if mitigated, and that an <br />EIR should be done. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON FINDS AND <br />DECLARES AS FOLLOWS: <br /> <br />Section 1. The decision of the Planning Commission granting a Condi- <br /> tional Use Permit to UP-78-6, is hereby reversed; the City <br /> Council is not able to make the findings required by Sec- <br /> tion 2-11.08 of the Pleasanton Ordinance Code, in particular <br /> finding (b) of that section, for reasons stated in Section 2 <br /> below. <br /> <br />Section 2. The Council makes its decision for the following reasons: <br /> <br />A. Additional truck and trailer traffic would be <br /> generated by the Diesel islands as proposed by <br /> <br /> <br />
