CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br />FOR P & M DEVELOPERS'OFFICE BUILDING COMPLEX ON MOHR <br />AVENUE <br /> <br />WHEREAS, <br /> <br />P & M Developers (Ted Myers) have received design review <br />approval for the construction of two 10,300 square feet <br />office buildings on a 3.1 acre parcel of land on Mohr <br />Avenue; and <br /> <br />before the developer can proceed with the project, it <br />will be necessary for developer to obtain City Council <br />approval for a holding tank permit in order to provide <br />sewage disposal for these buildings since there are no <br />sewer connections presently available; and <br /> <br />WHEREAS, <br /> <br />an application has been received from developer for <br />approval of a sewage holding tank to serve this proposed <br />development; and <br /> <br />WHEREAS, <br /> <br />this application has been reviewed by the City's Engineer- <br />ing Department and found to be in conformance with the <br />City's adopted policy concerning the use of holding tanks <br />for sewage disposal; and <br /> <br />WHEREAS, the Director of Engineering Services recommends approval <br /> of the permit; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1~ Approves a holding tank permit for P & M Developers <br /> (Ted Myers) to provide sewage disposal for the two 10,300 <br /> square feet office buildings on Mohr Avenue, subject to <br /> the following conditions: <br /> <br />(i) <br /> <br />That the property owner enter into a Standard Hold- <br />ing Tank Agreement with the City prior to issuance <br />of a building permit for this development. <br /> <br />(2) <br /> <br />That the property owners acknowledge in writing <br />their understanding of the probable magnitude <br />of monthly pumping charges and that they are <br />able and willing to meet this commitment as long <br />as the holding tank is necessary. <br /> <br />(3) <br /> <br />That approval be granted for a one-year period <br />pursuant to Resolution No. 73-140 (A Resolution <br />Establishing a Policy for Holding Tanks in the <br />City of Pleasanton) which requires that author- <br />ization to continue the use of a facility on a <br />holding tank must occur annually. <br /> <br />(4) <br /> <br />That the property owners acknowledge in writing, <br />prior to issuance of a building permit, their <br />understanding of the time limit of this approval <br />and that City Council is not obligated to auto- <br />matically grant approval for continued use of <br />the holding tank. <br /> <br /> <br />
