CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA FOR P & M DEVELOPERS'OFFICE BUILDING COMPLEX ON MOHR AVENUE WHEREAS, P & M Developers (Ted Myers) have received design review approval for the construction of two 10,300 square feet office buildings on a 3.1 acre parcel of land on Mohr Avenue; and before the developer can proceed with the project, it will be necessary for developer to obtain City Council approval for a holding tank permit in order to provide sewage disposal for these buildings since there are no sewer connections presently available; and WHEREAS, an application has been received from developer for approval of a sewage holding tank to serve this proposed development; and WHEREAS, this application has been reviewed by the City's Engineer- ing Department and found to be in conformance with the City's adopted policy concerning the use of holding tanks for sewage disposal; and WHEREAS, the Director of Engineering Services recommends approval of the permit; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1~ Approves a holding tank permit for P & M Developers (Ted Myers) to provide sewage disposal for the two 10,300 square feet office buildings on Mohr Avenue, subject to the following conditions: (i) That the property owner enter into a Standard Hold- ing Tank Agreement with the City prior to issuance of a building permit for this development. (2) That the property owners acknowledge in writing their understanding of the probable magnitude of monthly pumping charges and that they are able and willing to meet this commitment as long as the holding tank is necessary. (3) That approval be granted for a one-year period pursuant to Resolution No. 73-140 (A Resolution Establishing a Policy for Holding Tanks in the City of Pleasanton) which requires that author- ization to continue the use of a facility on a holding tank must occur annually. (4) That the property owners acknowledge in writing, prior to issuance of a building permit, their understanding of the time limit of this approval and that City Council is not obligated to auto- matically grant approval for continued use of the holding tank.
