WHE~AS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 78-251 A RESOLUTION APPROVING A MITIGATED NEGATIVE DECLARATION FOR CASE PUD-78-3 THE APPLICATION OF H. C. ELLIOTT, INC., FOR DEVELOPMENT PLAN APPROVAL OF A COMMERCIAL/RESIDENTIAL PLANNED UNIT DEVELOPMENT ON THE 14-ACRE SITE LOCATED BETWEEN TAWNY DRIVE, PALOMINO DRIVE AND PICO AVENUE the City Council at its meeting of October 3, 1978, received a proposed negative declaration for case PUD-78-3 the appli- cation of H. C. Elliott, Inc., for development plan approval Of a Commercial/Residential planned unit development on the 14-acre site located between Tawny Drive, Palomino Drive and Pico Avenue (hereinafter referred to as the Project); and staff has determined that the proposed development plan is a project for the purposes of the California EnvirorrnentalQualityAct; and said proposal was based upon an Initial Study dated August 8, 1978, done pursuant to the Environmental Impact Guidelines and Procedures adopted by the City Council of the City of Pleasanton by Resolution No. 77-66; and the Planning Commission at its meeting of August 9, 1978, received the Initial Study and proposed Negative Declaration in a report from the Director of Community Development dated August 8, 1978, regarding the aforementioned project; and upon receipt of the staff report and public input, the Planning Commission reviewed the provisions of the City's Guidelines and Processing Procedures for the evaluation of projects and the preparation of Environmental Impact Reports as they pertain to requirements for Negative Declaration and Environmental Impact Reports in order to determine if a Negative Declaration is appropriate for the project and what mitigation measures, if any, must be undertaken to ensure that the project will not have a significant impact upon the environment; and the Planning Commission determined by Planning Coranission Resolution No. 1664, that the project would not have any significant effects on the environment to require the prep- aration of an Environmental Impact Report, since any adverse effects are capable of being mitigated, and recommended that the Project be approved subject to conditions set forth in Resolution No. 1664, attached hereto, as Exhibit A, and in- corporated herein by reference; and the City Council, at its meeting of October 3, 1978, received and reviewed the Initial Study for the Project dated Augus't 8, 1978, together with the proposed mitigated Negative Declaration; and III
