Item <br />Staff Report <br />PLANNING COMMISSION <br />-August 9, 1978 <br /> <br /> SUBJECT: Z-78-97 <br /> <br />APPLICANT: <br /> <br />Kismet Construction, Inc. <br /> <br />PURPOSE: <br /> <br />Application for design review renewal for a <br />proposed 35-unit apartment complex to be located <br />at the southwest corner of the intersection of <br />Sonoma Drive and San Carlos Way. Zoning for the <br />property RM-1500 District. <br /> <br />ATTACHMENTS: 1. Exhibit A, site plan elevations and <br /> landscape plan. <br /> 2. Staff Report to the Design Review Board <br /> dated 7/13/77. <br />Also included as 6a on this agenda is case RZ-78-7, the application <br />of the City Council to rezone three sites in the Mission Park area. <br />One of those sites is the property described above. As mentioned <br />in the staff report for case RZ-78-7, a 35-unit apartment complex <br />received design review approval on the subject site. This approval <br />was granted on July 13, 1977, and has since lapsed. The proponents <br />are seeking a renewal of those same design plans. <br /> <br />The proposed project is described in the staff report to the Design <br />Review Board dated July 13, 1977, attached hereto. Please refer to <br />that document for further details of this case. <br /> <br />A negative declaration was prepared for the initial submittal in <br />1977. Since the project has not changed in the interim, no further <br />environmental assessment is required for this case. <br /> <br />Staff Recomniendation: Design review of this case has been included <br />with the rezoning described in case RZ-78-7. If your Commission <br />recommends rezoning the subject site to RM-4000, you should not approve <br />the design of these plans because the density would be greater than <br />allowed by the RM-4000 District. However, if you recommend that the <br />subject property remain in the ~4-1500 zoning district, the staff <br />recommends approval of case Z-78-97 subject to the following conditions: <br /> <br />That approval of this case is subject to conditions 1 through <br />17 and 19 through 22 of the staff report to the Design Review <br />Board dated July 13, 1977, attached hereto and-made a part of <br />this case by reference. <br /> <br />That this project is subject to Residential Allocation Program <br />approval and no building permits can be issued for any con- <br />struction on the site until such approval has been received <br />from the City. <br /> <br />That because a rezoning of the subject site has been initiated by <br />the City Council, case Z-78-97 shall become null and void if before <br />issuance of a building permit the property is rezoned to a zoning <br />district which prohibits the development shown in Exhibit A. <br /> <br /> <br />
