WHER~S, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />NOW, <br />RESOLVE AS <br /> <br />CITY OF PLEASA~]TON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 79-37 <br /> <br />APPROVING APPLICATION OF HARRY HEMPY FOR A SEPTIC <br />TANK PERMIT AT 5000 FOOTHILL ROAD. <br /> <br />Harry Hempy desires to build a single-family residence <br />on approximately 4.6 acres of land he owns at <br />5000 Foothill Road, Assessor's Parcel 941-1980-3-1; and <br /> <br />There is presently no sewer service available for this <br />area, Mr. Hempy has made application for a permit to <br />construct a septic tank on said property; and <br /> <br />The City Council on August 6, 1973, adopted Resolution <br />No. 73-139 (A Resolution Establishing a Policy Regarding <br />the Use of Septic Tanks within the City of Pleasanton); <br />and <br /> <br />At their meeting of March 13, 1979, the City Council <br />received and considered the report of the Director of <br />Public Works and Utilities dated March 7, 1979, which <br />indicated that Mr. Hempy's application and the property <br />met most of the criteria set forth in Resolution No. <br />73-139. <br /> <br />THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> FOLLOWS: <br /> <br />Section 1. <br /> <br />Approves the septic tank application of Harry Hempy for <br />construction of a septic tank on the approximately <br />4°6 acres of land at 5000 Foothill Road, Assessor's <br />Parcel 941-1980-3-1, subject to the following <br />conditions: <br /> <br />(1) That the dwelling be connected to a public sewer <br /> as soon as permissible. <br /> <br />(2) That the dwelling be connected to a public water <br /> supply for its potable water. <br /> <br />(3) <br /> <br />That the applicant enter into a standard septic <br />tank agreement with the City prior to issuance <br />of a building permit on this site. Approval of <br />this application should also constitute authori- <br />zation for execution of this septic tank <br />agreement by the proper City officials. <br /> <br />(4) <br /> <br />That the requirements and conditions of the <br />Alameda County Health Department be fully <br />complied with. <br /> <br /> <br />
