CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 79-36 <br /> <br />A RESOLUTION APPROVING THE DESIGN OF THE BURGER KING <br />RESTAURANT WHILE MODIFYING DESIGN REVIEW BOARD ACCESS <br />CONDITIONS. <br /> <br />WHEREAS, <br /> <br />On February 20, 1979, the Design Review Board approved <br />design plans for the construction of a Burger King <br />Restaurant to be located on the east side of Hopyard <br />Road approximately 700 feet south of 1-580; and <br /> <br />Zoning for the property is C-F (Commercial Freeway) <br />District; and <br /> <br />WHEREAS, <br /> <br />Mr. Brad Hirst, representative for the Burger King <br />Restaurant, appealed the decision of the Design Review <br />Board prohibiting egress onto Hopyard Road; and <br /> <br />WHEREAS, <br /> <br />At the City Council meeting of February 27, 1979, the <br />Council agreed to review the entire matter of design <br />of the restaurant not just the exiting onto Hopyard <br />Road; and <br /> <br />WHEREAS, <br /> <br />On March 13, 1979, the City Council conducted this <br />review. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. <br /> <br />The Council grants design review approval for Z-79-11, <br />subject to the conditions as set forth in the resolution <br />of the Design Review Board (Resolution R-79-10), except <br />as modified herein. Conditions 4 and 5 of the Design <br />Review Board approval shall be deleted and the following <br />required in their place: <br /> <br />"4. That the existing barricade between the applicant's <br />site and the Mobil station property shall be permanently <br />replaced by a lower fence, the design of which shall be <br />submitted to and approved by the Planning Division prior <br />to the issuance of any building permits. <br /> <br />5. That the applicant enter into an agreement with the <br />City, to be approved by the City Attorney, with regard <br />to egress onto Hopyard Road. The agreement shall provide <br />that - <br /> <br /> A. Right turns shall be initially allowed onto <br /> Hopyard Road from the proposed development; <br /> <br /> B. The Planning staff shall review the impact of <br /> this right turn movement permitted by this <br /> condition to see whether such movement onto <br /> Hopyard Road creates traffic conflicts, hazards <br /> or accidents; <br /> <br /> <br />
