WHEREAS, <br /> <br />WHEREAS, <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALA~.~DA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 80-44 <br /> <br />RESOLUTION CERTIFYING ADEQUACY OF ENVIRONMENTAL IMPACT <br />REPORT AND ADOPTING STATE}~NT OF OVERRIDING CONSIDERA- <br />TIONS FOR PROJECT APPROVAL DESPITE SIGNIFICANT ENVIRON- <br />MENTAL EFFECT <br /> <br />an Environmental Impact Report was prepared for the rezoning <br />of a 69 acre site on the south side of Valley and immediately <br />easterly of Kolln Street to PUD (Planned Unit Development) <br />and was accepted as adequate and complete at that time; and <br /> <br />the same Environmental Impact Report has been used for <br />John and Joan Caroline's application for development <br />plan approval of the subject site since the development <br />plan as proposed was assumed in the preparation of the <br />Environmental Impact Report; and <br /> <br />the City Council held a public hearing on February 26, 1980 <br />at which time testimony was accepted relative to the adequacy, <br />completeness, and correctness of the Environmental Impact <br />Report; and <br /> <br />the Planning Commission has reviewed the Environmental <br />Impact Report for development plan and recommended that <br />it is complete and adequate; and <br /> <br />the City Council has reviewed and considered information <br />in the Environmental Impact Report; and <br /> <br />the Environmental Impact Report found many potentially <br />significant impacts, some of which have been mitigated <br />by conditions attached to the rezoning to the PUD desig- <br />nation, (particularly those relating to truck use and <br />access to the site) the remaining mitigation measures <br />being deferred until action on the development plan; and <br /> <br />the Environmental Impact Report designates many possible <br />impacts as potentially significant and suggests mitigation <br />measures for these as outlined in the December 12, 1979 <br />Staff Report to the Planning Commission; and <br /> <br />many of the mitigation measures discussed in the Environ- <br />mental Impact Report for remaining potentially significant <br />effects have been incorporated into the development plan; <br />and <br /> <br />several impacts remain potentially significant and have <br />had mitigation measures suggested in the Environmental <br />Impact Report and staff and Planning Commission recommen- <br />dations as found in the February 20, 1980 Staff Report; <br />and <br /> <br /> <br />
