residents adjacent to the use in residency zoned <br />property have opposed the granting of this conditional <br />use permit and the continued presence of the nuclear <br />laundry run by Interstate on health, safety and <br />land use grounds; and <br /> <br />WHEREAS, <br /> <br />the opponents of the project provided testimony that <br />truck traffic from the operation was disturbing to the <br />residents nearby; and that warehouse type activities <br />took place on the site including outside storage and <br />delivery doors left open while activities were taking <br />place inside; and that the facility created industrial <br />level noise disturbing to the residents nearby. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council determines that it cannot make the <br /> findings required by Section 2-11.08 of the Pleasanton <br /> Ordinance Code setting forth the required findings for <br /> granting of a conditional use permit in that: <br /> <br />The proposed location of the conditional use is not <br />in accord with the objectives of the zoning chapter <br />in that it does not foster harmonious, convenient <br />or workable relationships among land users and does <br />not protect and enhance real property values because <br />of its impact on neighboring residential and <br />corfanercial properties in that the warehouse type <br />activities including outside use and storage, leaving <br />delivery doors open while activities are taking place, <br />creation of industrial level noise, and delivery by <br />large trucks are incompatible with the existing and <br />planned development in this area. <br /> <br />That the proposed location of the conditional use <br />would be detrimental to the public health, safety and <br />welfare in that the nuclear laundry poses the possibility <br />of future accidents which could release small levels <br />of radioactivity into the surrounding neighborhood, <br />that some leakage may occur during the ordinary course <br />of operations, and that despite the low level of radio- <br />active materials kept at the site, the presence of <br />nuclear materials in and of themselves give the appear- <br />ance of potentially hazardous and unsafe conditions <br />and thus have a negative impact upon neighboring <br />residential and commercial use, from a local planning <br />perspective. <br /> <br />and therefore the conditional use permit cannot be approved. <br /> <br />Section 2: Based on the above findings, City Council denies the <br /> appeal of Interstate. -- <br /> <br /> <br />
