NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council of the City of Pleasanton makes the <br /> following findings of fact: <br /> <br />a. The City of Pleasanton Ordinance Code Section 4-3.18 <br /> limits the duration of a card room permit to one year. <br /> <br />Mr. Wallace F. Travasso's "Special Police Permit," <br />Permit 79-1, specifically states that Mr. Travasso' <br />card room permit expired on March 5, 1980. <br /> <br />On December 12, 1980, the date of the attempted <br />filing of a card room application by Wallace F. <br />Travasso, the building listed on his application <br />was and had been closed by order of the Building and <br />Health Departments of the City of Pleasanton as <br />unfit for human use and occupancy. <br /> <br />Prior to December 12, 1980 (On December 9, 1980) the <br />City Council of the City of Pleasanton had introduced <br />an ordinance limiting the number of legal card rooms <br />to one. <br /> <br />Section 2: The City Council of the City of Pleasanton concludes: <br /> <br />a. Wallace Fo Travasso's card room permit for 537 Main <br /> Street expired on March 5, 1980. <br /> <br />The Police Chief acted properly in refusing to consider <br />Wallace F. Travasso's application for a card room at <br />537 Main Street as such building was not available <br />for use or occupancy. <br /> <br />In addition, the Police Chief acted properly in <br />refusing to consider Wallace F. Travasso's application <br />for a card room at 537 Main Street where the Council had <br />previously introduced an ordinance limiting the number <br />of card rooms to one, and there already existed on <br />that date (December 12, 1980) an existing card room. <br /> <br />Section 3: Based on the above findings of fact, the City Council <br /> denies the appeal of Wallace F. Travasso from the decision <br /> of the Police Chief regarding a card room permit application. <br /> <br />Section 4: This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br />-2- <br /> <br /> <br />
