CITY COUNCIL OF THE CITY OF PLEASAiqTON <br /> <br />ALAmeDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-50 <br /> <br />APPROVING THE APPLICATION OF ERNEST PESTANA FOR <br />TENTATIVE MAP APPROVAL FOR TRACT 4372 FOR A 49-LOT <br />SINGLE-FAMILY RESIDENTIAL SUBDIVISION ON A 35 ACRE <br />SITE LOCATED BETWEEN THE ROSEPOINTE SUBDIVISION AND <br />HAPPY VALLEY ROAD, IMMEDIATELY WESTERLY OF AMBER <br />LANE <br /> <br />WHEREAS, <br /> <br />at the February 10, 1981 meeting, Council continued its <br />decision on the tentative map for Tract 4372 and asked <br />for a report on possible alternative designs for the <br />Amber Lane Alignment; and <br /> <br />WHEREAS, <br /> <br />in the report of Robert Warnick, Director of Public Works <br />and Utilities, dated February 18, 1981, two alternative <br />street alignments were presented for consideration; and <br /> <br />WHEREAS, a public hearing was held on February 24, 1981, at which <br /> time testimony was taken from interested parties. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves the application of Ernest Pestana for tentative <br /> map approval for Tract 4372 for a 49-1ot single-family resi- <br /> dential subdivision on a 35 acre site located between the <br /> Rosepointe subdivision and Happy Valley Road, immediately <br /> westerly of Amber Lane, subject to the conditions in Exhibit <br /> A, attached hereto and incorporated herein by reference. <br /> <br />Section 2~ The property is zoned R-i-20,000 (Single-Family Resi- <br /> dential) District as originally submitted and as modified <br /> by Resolution No. 81-33, accepting park fees rather than <br /> acreage. <br /> <br />Section 3. This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON FEBRUARY 24, 1981, BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers Butler, Kephart, and Mayor Mercer <br /> NOES: Councilmembers Mohr and Wood <br />ABSENT: None ~~FT~R~C~ <br />~.
