CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-99 <br /> <br />RESOLUTION APPROVING APPEAL OF KAISER SAND AND GRAVEL <br />ALLOWING THE CONSTRUCTION OF AN ELEVATOR STRUCTURE AT <br />3311 STANLEY BOULEVARD <br /> <br />WHEREAS , <br /> <br />Kaiser Sand and Gravel applied for a variance from the code <br />to allow construction of an elevator structure, which would <br />exceed 40 ft. in height, as part of an asphaltic concrete <br />plant on property located at 3311 Stanley Boulevard; and <br /> <br />WHEREAS, <br /> <br />at their meeting of March 12, 1981, the Board of Adjustment <br />denied the request for a variance to allow the 40 foot <br />structure; and <br /> <br />WHEREAS, Kaiser Sand and Gravel appealed the decision of the Board <br /> of Adjustment to the City Council; and <br /> <br />WHEREAS, <br /> <br />a public hearing was held on April 14, 1981, at which time <br />interested parties were given an opportunity to comment on <br />the project; and <br /> <br />WHEREAS, <br /> <br />Council received a report from the Director of Planning <br />and Community Development, dated April 8, 1981, which <br />recommended approval of the variance. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves the requested variance based on the findings <br /> set forth in Section 2 below and subject to the conditions <br /> set forth in Section 3 below. <br /> <br />Section 2. Council makes the following findings with regard to <br /> the granting of the variance: <br /> <br />That because of special circumstances applicable to <br />the property, namely; its location and surroundings <br />within a special industrial area devoted to sand and <br />gravel harvesting, the strict application of the <br />provisions of the zoning ordinance deprives such <br />property of privileges enjoyed by other properties <br />in the vicinity and under identical zoning classifi- <br />cation. <br /> <br />That the granting of the variance will not constitute <br />a grant of special privilege inconsistent with the <br />limitation on other properties classified in the same <br />zoning district because of the special nature of the <br />site's vicinity. <br /> <br />III <br /> <br /> <br />
