10.4 <br /> <br />10.5 <br /> <br />Designation of Beneficiaries - Each participant shall have <br />the right, by written notice to the employer, to designate <br />beneficiaries to receive any benefit to which said participant <br />may be entitled in the event of his death prior to the complete <br />distribution of benefits. If no such designation is in effect <br />on a participant's death, his beneficiary shall be his estate <br />or if no executor or administrator is appointed within six (6) <br />months after the participant's death, the employer shall direct <br />said benefits to be paid to the beneficiary or beneficiaries <br />designated in his last will, or if there be no will, then to <br />the heirs at law of the participant. <br /> <br />In the event of divorce, distribution will be made to the <br />participant and/or spouse according to the terms of the divorce <br />decree. <br /> <br />10.6 MISCELLANEOUS OTHER: <br /> <br />10.6(a) <br /> <br />Deductions for Participant's contributions to <br />retirement plans shall be made without reference <br />to amounts deferred pursuant to the Plan, <br /> <br />10.6 (h) <br /> <br />An ap~roved leave of absence with pay shall not <br />affect agreements to participate in the Plan. <br /> <br />i0.6(c) <br /> <br />An approved leave of absence without pay shall be <br />considered to be a temporary suspension of participation <br />in the Plan. Participation shall be automatically <br />reinstated as of the first day of the next Pay Period <br />subsequent to the termination of such leave ofahsence <br />status. <br /> <br />I0.6(d) <br /> <br />The Employer shall make no loa~s or advances to the <br />Participant or Beneficiary based upon TDC Accounts, <br />described herein, or upon any other obligations under <br />the Plan. <br /> <br />10.6(e.) <br /> <br />The Plan shall be binding upon the Employer, its <br />successors and assigns, all Participants add <br />Beneficiaries, and their heirs, and legal representatives. <br /> <br />10.6(f) <br /> <br />As used in the Plan, the masculine or feminine or <br />neuter gender, and the singular or plural number shall <br />each be deemed to include the others unless the content <br />clearly indicates otherwise. <br /> <br />10.6(g) <br /> <br />Any notice or other connnunication required or permitted <br />under the Plan shall be writing and, if directed to the <br />Employer, shall be sent to the City Manager or his <br />designated appointee at his principal office; and, if <br />directed to a Participant or a Beneficiary, shall be <br />sent to such Participant or Beneficiary, at his last- <br />known address as it appears on the Employer's records. <br />Such notice shall be deemed given when mailed. <br /> <br /> <br />
