7% Of construction cost (including contingencies) <br />for completion of the plans and specifications, <br />payable upon receipt of the proceeds of assessments <br />collected and/or bonds sold, but the amount subject <br />to adjustment until completion of construction; <br /> <br />4% of the construction cost for construction staking <br />and job coordination, payable in four equal payments <br />during the construction period (not including <br />inspection); <br /> <br />1% of the construction cost for the assessment pro- <br />ceedings required of the Engineer, payable upon <br />receipt of the proceeds of assessments collected <br />and/or bonds sold. <br /> <br />Printing and other services ordered by City shall be <br />paid by City on a time and materials basis in accord- <br />ance with the rate schedule attached hereto as Exhibit <br />A. The printing costs shall be included in the <br />incidental costs of the district. <br /> <br />The above amount shall be paid by City out of the proceeds <br /> <br />of assessments levied and bonds to be issued in said proceedings. In <br /> <br />no event, however, will the compensation of Engineer exceed the amount <br /> <br />set forth by Engineer for that purpose in the report, or any amended <br /> <br />report, prepared by him under Section 10204 of the Streets and Highways <br /> <br />Code. <br /> <br />4o In the event said proceedings are not carried through to <br /> <br />conclusion, or shall be abandoned, then Engineer shall receive nothing. <br /> <br /> 5. City agrees that in accordance with generally accepted construc- <br />tion practices, the construction contractor will be required to assume <br />sole and complete responsibility for job site conditions during the <br />course of construction of the project, including safety of all Oersons <br />and property; that this requirement shall be made to apply continuously <br />and not be limited to normal working hours. <br /> <br />-3- <br /> <br /> <br />
